AN ACT 1 Amending the act of December 27, 1974 (P.L.995, No.326), 2 entitled "An act regulating the practice of veterinary 3 medicine and imposing penalties," further providing for 4 disciplinary proceedings. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 21(11) of the act of December 27, 1974 8 (P.L.995, No.326), known as the Veterinary Medicine Practice 9 Act, amended December 9, 2002 (P.L.1370, No.167), is amended to 10 read: 11 Section 21. Grounds for Disciplinary Proceedings.--The board 12 shall suspend or revoke any license or certificate or otherwise 13 discipline an applicant, licensee or certificate holder who is 14 found guilty by the board or by a court of one or more of the 15 following: 16 * * * 17 (11) Incompetence, gross negligence or other malpractice, or 18 the departure from, or failure to conform to, the standards of
1 acceptable and prevailing veterinary medical practice, in which 2 case actual injury need not be established. Failure of a 3 licensee to perform prescreening of an animal, such as 4 conducting a blood test, prior to use of a drug, if the 5 prescreening is recommended by the drug manufacturer, may be 6 evidence in a disciplinary action at the discretion of the 7 board.
