AN ACT
1 Amending Title 65 (Public Officers) of the Pennsylvania
2 Consolidated Statutes, further providing for EXECUTIVE <--
3 SESSIONS AND FOR a penalty.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 714 of Title 65 of the Pennsylvania <--
7 Consolidated Statutes is amended to read:
8 SECTION 1. SECTION 708(A) OF TITLE 65 OF THE PENNSYLVANIA <--
9 CONSOLIDATED STATUTES IS AMENDED BY ADDING A PARAGRAPH TO READ:
10 § 708. EXECUTIVE SESSIONS.
11 (A) PURPOSE.--AN AGENCY MAY HOLD AN EXECUTIVE SESSION FOR
12 ONE OR MORE OF THE FOLLOWING REASONS:

14 (7) TO DISCUSS OR PLAN MATTERS RELATED TO SAFETY AND
15 SECURITY WHICH IF DISCLOSED WOULD JEOPARDIZE THE INTEGRITY OF
16 THE AGENCY'S SAFETY OR SECURITY OPERATION OR REVEAL
17 VULNERABILITY ASSESSMENTS, RISKS, SPECIFIC TARGETS OR
1 SPECIFIC EMERGENCY OR SECURITY PROCEDURES OR CODES.

3 SECTION 2. SECTION 714 OF TITLE 65 IS AMENDED TO READ:
4 § 714. Penalty.
5 Any member of any agency who participates in a meeting with
6 the intent and purpose by that member of violating this chapter
7 commits a summary offense and shall, upon conviction, be
8 sentenced to pay a fine not exceeding [$100] $1,000 plus costs
9 of prosecution[.] for a first offense and a fine not exceeding
10 $2,000 plus costs of prosecution for a second or subsequent
11 offense. An agency shall not make a payment on behalf of or
12 reimburse a member of an agency for a fine or cost resulting
13 from the member's violation of this section.
