                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for certain passenger restrictions.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The heading of section 1503 of Title 75 of the
     6  Pennsylvania Consolidated Statutes is amended and the section is
     7  amended by adding a subsection to read:
     8  § 1503.  Persons ineligible for licensing; license issuance to
     9             minors; junior driver's license; passenger
    10             restrictions.

    12     (d)  Passenger restrictions.--Except as provided in paragraph
    13  (1), a driver under 18 years of age may not drive a vehicle with
    14  more than one passenger under 18 years of age.
    15         (1)  A driver under 18 years of age may drive a vehicle
    16     with more than one passenger under 18 years of age when:
    17             (i)  a parent or a person in loco parentis of the


     1         driver is also a passenger;
     2             (ii)  a parent or a person in loco parentis of a
     3         passenger under 18 years of age is also a passenger; or
     4             (iii)  the passengers under 18 years of age are the
     5         siblings or relatives of the driver and live in the same
     6         dwelling as the driver.
     7         (2)  In addition to the other provisions of this title
     8     relating to the suspension or revocation of operating
     9     privileges, in the event that a driver under 18 years of age
    10     is involved in an accident reportable under section 3746(a)
    11     for which the driver is partially or fully responsible in the
    12     opinion of the department and is found to be in violation of
    13     this subsection, the department may suspend the operating
    14     privileges of the driver until the driver attains 18 years of
    15     age or for a period of time not exceeding 90 days.
    16         (3)  Any driver violating this subsection commits a
    17     summary offense.
    18     Section 2.  This act shall take effect in 60 days.
