AN ACT 1 Providing for the regulation of indoor tanning facilities and 2 for penalties. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Indoor 7 Tanning Regulation Act. 8 Section 2. Definitions. 9 The following words and phrases when used in this act shall 10 have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Customer." A member of the public who is provided access to 13 a tanning facility in exchange for a fee or other compensation 14 or any individual who, in exchange for a fee or other 15 compensation, is afforded use of a tanning facility as a 16 condition or benefit of membership or access. 17 "Department." The Department of Health of the Commonwealth.
1 "Fitzpatrick scale." A scale for classifying a skin type, 2 based on the skin's reaction to the first ten to 45 minutes of 3 sun exposure after the winter season as follows: 4 Skin Type Sunburning and Tanning History 5 1 Always burns easily, never tans 6 2 Always burns easily, tans minimally 7 3 Burns moderately, tans gradually 8 4 Burns minimally, always tans well 9 5 Rarely burns, tans profusely 10 6 Never burns, deeply pigmented 11 "Operator." An individual designated by the licensee to 12 control operation of the tanning facility and to instruct and 13 assist the customer in the proper operation of the tanning 14 equipment. 15 "Person." An individual, partnership, corporation or 16 association. 17 "Phototherapy device." Equipment that emits ultraviolet 18 radiation and is used by health care professionals in the 19 treatment of disease. The term shall not include any of the 20 following: 21 (1) Devices utilized by appropriate health care 22 professionals under the direct supervision of a physician who 23 is trained in the use of phototherapy devices. 24 (2) Devices used for personal use in a private 25 residence. 26 (3) Devices intended for purposes other than the 27 irradiation of human skin. 28 "Tanning equipment or device." Equipment that emits 29 radiation used for tanning of the skin, such as a sunlamp, 30 tanning booth or tanning bed that emits electromagnetic 20070S0406B0453 - 2 -
1 radiation with wavelengths in the air between 200 and 400 2 nanometers. The term includes any accompanying equipment, such 3 as protective eyewear, timers and handrails. 4 "Tanning facility." Any place where a tanning device is used 5 for a fee, membership dues or any other compensation. 6 "Ultraviolet radiation." Electromagnetic radiation with 7 wavelengths between 200 and 400 nanometers. 8 Section 3. Licensing and fees. 9 (a) Requirement.--No person shall establish, maintain, 10 operate or hold itself out as authorized to establish, maintain 11 or operate a tanning facility without first having obtained a 12 license issued by the department. 13 (b) Application.--A person may apply for a license required 14 under subsection (a) by submitting an application to the 15 department on a form prescribed by the department. The form 16 shall require all of the following information: 17 (1) The name, address and telephone number of the 18 tanning facility and owner. 19 (2) The manufacturer, model number and type of each 20 ultraviolet lamp or tanning device used in the tanning 21 facility. 22 (3) The name of the equipment supplier, installer and 23 service agent of each ultraviolet lamp or tanning device used 24 in the tanning facility. 25 (4) A signed and dated certification that the applicant 26 has read and understands the requirements of this act. 27 (5) A copy of the operating and safety procedures of the 28 tanning facility. 29 (6) Any additional information required by the 30 department. 20070S0406B0453 - 3 -
1 (c) Determination.--The department shall issue a license to 2 an applicant upon determination that the applicant meets all of 3 the requirements of this act. 4 (d) Fee.--An applicant shall be required to pay a license 5 fee, based on the number of tanning devices, in an amount 6 sufficient to cover the cost of annual inspection and 7 administration of this act. 8 (e) Posting.--A licensee shall post its license in a 9 location clearly visible to its customers. 10 (f) Expiration.--A license shall expire annually on the date 11 specified in the license. 12 (g) Renewal.--A licensee must file an application for 13 renewal on a form prescribed by the department prior to 14 expiration of its current license. 15 (h) Transfer.--A license shall not be transferable from one 16 person or one tanning facility to another. 17 (i) Denial, suspension or revocation.--The following shall 18 apply to the denial, suspension or revocation of a license: 19 (1) The department shall have the authority to deny, 20 suspend or revoke licensure for any of the following reasons: 21 (i) Submission of false statements in application, 22 reports, plans or specifications. 23 (ii) For conditions which violate this act. 24 (iii) Operation of the tanning facility in a manner 25 that threatens public health or safety. 26 (iv) Failure to allow the department to enter the 27 tanning facility at reasonable hours for inspection or 28 investigation. 29 (v) Failure to pay license fees. 30 (2) Except in cases involving public health and safety, 20070S0406B0453 - 4 -
1 the department shall, prior to suspension or revocation of a 2 license, provide written notice to the licensee of the facts 3 or conduct which may warrant suspension or revocation and 4 shall provide the licensee with an opportunity to demonstrate 5 or achieve compliance. The licensee may request an 6 administrative hearing upon receipt of the written notice. 7 Section 4. Inspection. 8 (a) Time.--The department shall conduct an initial 9 inspection, after receipt of an application for a license under 10 section 3 and before the license is granted, of a tanning 11 facility and each year thereafter. 12 (b) Conduct.--Inspections conducted by the department under 13 this section shall encompass all of the following matters: 14 (1) The construction and operation of the tanning 15 facility. 16 (2) Review of required records and training 17 documentation. 18 (3) Operator understanding and competency. 19 (4) Any other area concerning a requirement of this act. 20 Section 5. Warning signs and statements. 21 (a) Warning signs and statements describing hazards.--A 22 tanning facility shall post a warning sign in a place readily 23 visible to persons entering the establishment. The sign shall 24 have dimensions not less than 11 inches by 17 inches. Lettering 25 must be clear, legible and at least 0.25 inches high, with all 26 of the following provisions on the sign: 27 (1) The wording, "DANGER--ULTRAVIOLET RADIATION", in 28 letters at least 0.5 inches high. 29 (2) Follow the manufacturer's instructions for use of 30 this device. 20070S0406B0453 - 5 -
1 (3) Avoid overexposure. As with natural sunlight, 2 overexposure can cause eye and skin injury and allergic 3 reactions. Repeated exposure to ultraviolet radiation may 4 cause chronic sun damage characterized by wrinkling, dryness, 5 fragility, bruising of the skin and skin cancer. 6 (4) Do not sunbathe before or after exposure to 7 ultraviolet radiation from sunlamps. 8 (5) Wear protective eyewear. Failure to use protective 9 eyewear may result in severe burns or permanent injury to the 10 eyes. 11 (6) Medications or cosmetics may increase your 12 sensitivity to the ultraviolet radiation. Consult a physician 13 before using a sunlamp if you are using medications, have a 14 history of skin problems or believe you are especially 15 sensitive to sunlight. Women who are pregnant or are taking 16 oral contraceptives who use this product may develop 17 discolored skin. 18 (7) A customer may call the Department of Health at 19 (insert telephone number) to report an alleged injury 20 regarding this tanning facility. 21 (8) The wording, "IF YOU DO NOT TAN IN THE SUN, YOU ARE 22 UNLIKELY TO TAN FROM USE OF AN ULTRAVIOLET LAMP OR SUNLAMP". 23 (b) Posting.--The sign under subsection (a) shall also be 24 posted within three feet of each tanning device, in a 25 conspicuous location that is readily visible to a person about 26 to use the device with no obstruction. 27 (c) Written warning statement.--Each customer shall be 28 provided with a written warning statement requiring their 29 signature prior to initial exposure and before renewals of 30 contracts. 1 following: 2 (1) Failure to use the eye protection provided to the 3 customer by the tanning facility may result in damage to the 4 eyes. 5 (2) Overexposure to ultraviolet light causes burns. 6 (3) Repeated exposure may result in premature aging of 7 the skin and skin cancer. 8 (4) Abnormal skin sensitivity or burning may be caused 9 by reactions of ultraviolet light to certain: 10 (i) foods; 11 (ii) cosmetics; or 12 (iii) medications, including: 13 (A) tranquilizers; 14 (B) diuretics; 15 (C) antibiotics; 16 (D) high blood pressure medicines; or 17 (E) birth control pills. 18 (5) Any person taking a prescription or over-the-counter 19 drug should consult a physician before using a tanning 20 device. 21 (6) A person with skin that always burns easily and 22 never tans should avoid a tanning device. 23 (7) A person with a family or past medical history of 24 skin cancer should avoid a tanning device. 25 (d) Liability.--The warning statement provided under 26 subsection (c) shall not affect the liability of the owner, 27 manager or operator of a tanning facility in the event that a 28 customer fails to follow the warning statement and incurs 29 damages. 30 Section 6. 1 (a) Federal certification.--Only tanning devices 2 manufactured and certified under 21 CFR 1040.20 (relating to 3 sunlamp products and ultraviolet lamps intended for use in 4 sunlamp products) may be used in tanning facilities. 5 (b) Device labeling.--Each tanning device shall be 6 permanently labeled in a conspicuous place with the following 7 information: 8 (1) The warning statement required under section 5(c). 9 (2) Recommended exposure positions. 10 (3) Recommended duration and frequency of exposure. 11 (4) The length of time before expected results appear. 12 (5) Lamp types. 13 (c) Tanning device timers.--Tanning device timers shall meet 14 all of the following requirements: 15 (1) Compliance with 21 CFR 1040.20. 16 (2) Permit remote timer control by operators so that 17 customers may not reset the timer. 18 (3) Permit manual control for customer in order to 19 terminate radiation emission. 20 (d) Facility temperature.--An operator shall control the 21 interior of a tanning facility so that it does not exceed 100 22 degrees Fahrenheit. 23 (e) Privacy.--A facility shall adopt and instruct all 24 employees in procedures to ensure the reasonable privacy of 25 customers. 26 (f) Condition.--All tanning devices shall do all of the 27 following: 28 (1) Meet the National Fire Protection Association's 29 National Electrical Code and any other State or local 30 electrical codes. 20070S0406B0453 - 8 -
1 (2) Have physical barriers to protect customers from 2 injury due to touching or breaking lamps. 3 (3) Be maintained in good repair. 4 (g) Stand-up booths.--Stand-up booths shall meet all of the 5 following conditions: 6 (1) Have physical barriers or other means to indicate 7 proper exposure distance. 8 (2) Be constructed rigidly enough to withstand stress of 9 use and impact of a falling person. 10 (3) Access shall be of rigid construction, doors must 11 open outwardly and handrails and nonslip floors must be 12 provided. 13 (h) Protective eyewear.--Operators shall require customers 14 to wear protective eyewear in order to use a tanning device. 15 When a tanning device is in use, no other person shall be 16 allowed to remain in the area unless the person wears protective 17 eyewear. Protective eyewear shall do all of the following: 18 (1) Be provided free of charge, along with instructions 19 for use. Customers may also be given the option to purchase 20 their own eyewear. 21 (2) Meet the requirements of 21 CFR 1040.20. 22 (3) Be properly sanitized before each use. Ultraviolet 23 rays shall not be considered a sanitizing agent. 24 Section 7. Operation. 25 (a) Presence.--A trained operator must be present when 26 tanning equipment is operated. The operator must be within 27 hearing distance to allow the customer to easily summon help if 28 necessary or the customer must have access to an intercom or 29 buzzer for the operator and the operator must be able to reach 30 the customer in 30 seconds. 20070S0406B0453 - 9 -
1 (b) Control.--Tanning equipment must have a control that 2 enables the user to manually terminate radiation without pulling 3 the electrical plug or coming in contact with the ultraviolet 4 lamp. 5 (c) Instruction.--Operators shall instruct customers in 6 regard to all of the following: 7 (1) The proper position to maintain relative to the 8 equipment. 9 (2) The position of the safety railing, if applicable. 10 (3) The operation of the manual switching device to 11 terminate radiation. 12 (4) The maximum time of exposure. 13 (d) Skin type.--Operators must be able to recognize the skin 14 type of the customer based on the Fitzpatrick scale and advise 15 the customer accordingly in regard to maximum time of exposure. 16 (e) Customer records.--A record shall be kept of each 17 customer's total number of tanning visits, date, time and 18 duration of each, as well as medications taken and any injuries 19 or illness resulting from the use of the device. 20 (f) Reports of injuries.--A written or oral report of any 21 tanning injury must be provided to the department by the end of 22 the next working day after its occurrence or upon gaining 23 knowledge of the accident. The report shall include the name of 24 the affected individual, the name and location of tanning 25 facility, the nature of injury, the name and address of a health 26 care provider, if applicable, and any other relevant 27 information. The department shall send reports of all injuries 28 to the United States Food and Drug Administration. 29 (g) Bulbs.--At intervals required by the manufacturer, bulbs 30 shall be replaced with a kind intended for use in that device or 20070S0406B0453 - 10 -
1 with lamps or filters considered equivalent under United States 2 Food and Drug Administration regulations at the time of 3 manufacture. Records shall be maintained and accessible to 4 customers. Facilities must also post dates of bulb changing 5 where visible on every tanning device. The requirements of this 6 subsection shall also apply to defective or burned-out lamps or 7 filters. 8 (h) Sanitation.--Contact surfaces of tanning devices must be 9 cleansed between uses by the tanning facility with a cleansing 10 agent approved by the department. After cleansing each time, a 11 visible sign must be placed on the bed or booth indicating that 12 it has been properly cleaned. Bathrooms and dressing rooms must 13 also be properly sanitized and customers must be provided with 14 clean towels and washcloths. 15 (i) Records.--All records or documentation required by this 16 act shall be maintained in the tanning facility for a minimum of 17 three years. Records on computer must be backed up on storage 18 media other than the hard drive at least monthly and must be 19 retrievable as a printed copy. Records shall be accessible by 20 the department during an inspection. 21 (j) Duration and frequency.--Operators shall limit session 22 duration and frequency to maximums recommended by the 23 manufacturer. 24 Section 8. Restrictions on use by minors. 25 (a) Accompaniment.--All minors 14 to 18 years of age shall 26 be accompanied by their parent or legal guardian in order to use 27 a tanning device. 28 (b) Identification.--Before each use by a minor 14 to 18 29 years of age, the parent or legal guardian shall present photo 30 identification and the owner or operator shall witness the 20070S0406B0453 - 11 -
1 parent's or legal guardian's signing and dating of the warning 2 statement required under section 5(c). The parent or legal 3 guardian shall also sign a statement stating the relationship 4 with a child who is under 14 years of age. 5 (c) Medical permission.--Persons under 14 years of age may 6 not use a tanning device unless they present written permission 7 by a properly licensed doctor of medicine or doctor of 8 osteopathic medicine. 9 (d) Duty.--It shall be the duty of the tanning facility 10 owner to ensure that each customer utilizing the tanning 11 facility is of legal age to do so. The tanning facility owner 12 shall be held responsible for the use of the tanning facility by 13 anyone under 18 years of age who is not accompanied by a parent 14 or legal guardian even if the customer presents falsified photo 15 identification. Failure to ensure that a customer is of legal 16 age to utilize the tanning facility shall result in permanent 17 revocation of the license. 18 (e) Records.--Records of parental consent shall be 19 maintained for all minor customers of the tanning facility for a 20 period of at least three years. 21 Section 9. Training. 22 (a) Operators.--An individual shall satisfactorily complete 23 a training program before the individual can function as an 24 operator. The training program shall include all of the 25 following: 26 (1) The requirements of this act. 27 (2) Procedures for correct operation of the tanning 28 facility and devices. 29 (3) The determination of skin type of customers, 30 including skin types based on the Fitzpatrick scale. 20070S0406B0453 - 12 -
1 (4) The duration and frequency of exposure. 2 (5) Recognition of reaction, injury or overexposure. 3 (6) The manufacturer's procedures for operation and 4 maintenance of tanning devices. 5 (7) Health risks. 6 (8) Emergency procedures in case of injury. 7 (9) Customer refusal tactics. 8 (b) Owners and managers.--Owners and managers shall do all 9 of the following: 10 (1) Complete formal training and pass a certification 11 examination, approved by the department, before operating a 12 tanning facility or training employees. 13 (2) Train operators under subsection (a) and provide 14 review as necessary. 15 (c) Inspections.--The department shall investigate the level 16 of an individual's understanding and competency during 17 inspections. 18 (d) Proof.--Proof of training for owners, managers and 19 employees shall be maintained and available for inspection. 20 Section 10. Promotional materials. 21 A tanning facility may not claim or distribute promotional 22 materials that claim that using a tanning device is safe or free 23 from risk or that the use of a tanning device will result in 24 medical or health benefits. A tanning facility may only claim or 25 distribute promotional materials that claim that a tanning 26 device is for cosmetic use only. 27 Section 11. Inspections, violations and injunctions. 28 (a) Access.--The department shall have access at reasonable 29 times to any tanning facility, including its records, to inspect 30 and determine whether a violation of this act has or will occur. 20070S0406B0453 - 13 -
1 (b) Penalty.--A person who operates a tanning facility in 2 violation of this act commits a misdemeanor and shall be subject 3 to suspension or revocation of the tanning facility's license. A 4 person who operates or uses a tanning device in violation of 5 this act commits a misdemeanor. 6 (c) Suspension or revocation.--If the department finds a 7 violation of this act that creates an immediate threat to the 8 health and safety of the public, the department may suspend or 9 revoke the tanning facility's license to operate. 10 (d) Procedure.-- 11 (1) The department may take the following steps in 12 writing or use any other acts and regulations to enforce the 13 provisions of this act: 14 (i) Cite each section of the act violated. 15 (ii) Specify the manner in which the owner, manager 16 or operator failed to comply with this act. 17 (iii) Require a corrective action plan, including a 18 reasonable time schedule for completion. The department 19 shall review the corrective action plan and approve or 20 require modification of the plan. 21 (2) If a tanning facility fails to comply with 22 conditions of the written notice provided under paragraph 23 (1), the department shall notify the owner, manager or 24 operator, by certified mail, that unless action is taken 25 within five days of receipt of the written notice, the 26 tanning facility's license shall be suspended or revoked. 27 Section 20. Severability. 28 The provisions of this act are severable. If any provision of 29 this act or its application to any person or circumstance is 30 held invalid, the invalidity shall not affect other provisions 20070S0406B0453 - 14 -
