                                     AN ACT

     1  Amending Title 65 (Public Officers) of the Pennsylvania
     2     Consolidated Statutes, further providing for statement of
     3     financial interests.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1104(b) of Title 65 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1104.  Statement of financial interests required to be filed.
     9     * * *
    10     (b)  Candidate.--
    11         (1)  (i)  Any candidate for a State-level public office
    12         shall file a statement of financial interests for the
    13         preceding calendar year with the commission on or before
    14         the last day for filing a petition to appear on the
    15         ballot for election. A copy of the statement of financial
    16         interests shall also be appended to such petition.
    17             (ii)  The candidate for office may file the statement
    18         of financial interests after the last day for filing a

     1         petition if, in the discretion of a court of competent
     2         jurisdiction, the court finds that there was a good faith
     3         effort to timely file the statement and that the
     4         statement has since been filed as set forth in this
     5         paragraph.
     6         (2)  (i)  Any candidate for county-level or local office
     7         shall file a statement of financial interests for the
     8         preceding calendar year with the governing authority of
     9         the political subdivision in which he is a candidate on
    10         or before the last day for filing a petition to appear on
    11         the ballot for election. A copy of the statement of
    12         financial interests shall also be appended to such
    13         petition.
    14             (ii)  The candidate for office may file the statement
    15         of financial interests after the last day for filing a
    16         petition if, in the discretion of a court of competent
    17         jurisdiction, the court finds that there was a good faith
    18         effort to timely file the statement and that the
    19         statement has since been filed as set forth in this
    20         paragraph.
    21         (3)  All of the following apply:
    22             (i)  No petition to appear on the ballot for election
    23         shall be accepted by the respective State or local
    24         election officials unless the petition has appended
    25         thereto a statement of financial interests as set forth
    26         in paragraphs (1) and (2).
    27             (ii)  (A)  Failure to file the statement in
    28             accordance with the provisions of this chapter shall,
    29             in addition to any other penalties provided, be a
    30             fatal defect to a petition to appear on the ballot.

     1                 (B)  This subparagraph does not preclude a court
     2             of competent jurisdiction, in an action brought to
     3             set aside a nomination petition or a nomination
     4             paper, from permitting amendment of a statement of
     5             financial interests to correct nonfraudulent errors
     6             or omissions in the content of the statement of
     7             financial interests as long as the statement of
     8             financial interests was filed with the commission or
     9             the governing authority of the political subdivision,
    10             as applicable, as set forth in paragraph (1) or (2).

    12     Section 2.  This act shall take effect in 60 days.
