                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for supplemental funding
     6     for new students; establishing a special account; and making
     7     an appropriation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 2554.  Supplemental Assistance for New Students.--(a)
    14  The New Student Supplemental Assistance Account is established
    15  as a special account in the State Treasury.
    16     (b)  The purpose of the account is to provide supplemental
    17  funding to school districts for the addition of new students.
    18     (c)  The sources of the account are as follows:
    19     (1)  Appropriations.
    20     (2)  Return on the money in the account.

     1     (d)  The Department of Education shall use the account to
     2  provide each school district with supplemental funding as
     3  follows:
     4     (1)  By November 15, each school district shall do all of the
     5  following:
     6     (i)  Determine average daily membership for the current
     7  school year as of November 1.
     8     (ii)  Determine average daily membership for the previous
     9  school year as of November 1.
    10     (iii)  Subtract the determination under subparagraph (ii)
    11  from the determination under subparagraph (i).
    12     (iv)  If the difference under subparagraph (iii) is a
    13  positive number, certify the number to the department.
    14     (2)  By February 1, the department shall provide each school
    15  district that has made a certification under paragraph (1)(iv)
    16  with supplemental funding by doing the following:
    17     (i)  Divide:
    18     (A)  the school district's basic education funding; by
    19     (B)  the school district's average daily membership.
    20     (ii)  Multiply:
    21     (A)  the quotient under subparagraph (i); by
    22     (B)  the number certified under paragraph (1)(iv).
    23     (iii)  Make a payment to the school district in the amount of
    24  the product under subparagraph (ii).
    25     (e)  Each year, the Secretary of Education shall make a
    26  budget request to fund the account.
    27     (f)  The money in the account is continuously appropriated
    28  into the account. This appropriation shall not lapse at the end
    29  of any fiscal year.
    30     Section 2.  The sum of $30,000,000 is hereby appropriated to

     1  the New Student Supplemental Assistance Account for the fiscal
     2  year July 1, 2007, to June 30, 2008, to carry out the provisions
     3  of the addition of section 2554 of the act. This appropriation
     4  is subject to section 2554(f) of the act.
     5     Section 3.  This act shall take effect in 60 days.
