AN ACT
1 Amending the act of December 19, 1984 (P.L.1093, No.219),
2 entitled "An act relating to noncoal surface mining
3 conservation and reclamation," providing for the operation of
4 green field quarries.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The act of December 19, 1984 (P.L.1093, No.219),
8 known as the Noncoal Surface Mining Conservation and Reclamation
9 Act, is amended by adding a section to read:
10 Section 23.1. Operation of green field quarries.
11 (a) Prohibition.--Notwithstanding any other provision of
12 this act or any other statute, a person shall not conduct a
13 green fields quarry operation within 1,500 feet of a public or
14 private school.
15 (b) Definition.--As used in this section, the term "green
16 fields" means land which has never been developed for uses other
17 than agriculture, forestry or recreation.
18 Section 2. This act shall take effect in 60 days.
