                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for disqualification for
     3     commercial driver's license.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1611(a)(5) of Title 75 of the
     7  Pennsylvania Consolidated Statutes is amended to read:
     8  § 1611.  Disqualification.
     9     (a)  Disqualification for first violation of certain
    10  offenses.--Upon receipt of a report of conviction, the
    11  department shall, in addition to any other penalties imposed
    12  under this title, disqualify any person from driving a
    13  commercial motor vehicle or school vehicle for a period of one
    14  year for the first violation of:

    16         (5)  any felony or any misdemeanor under 18 Pa.C.S. Ch.
    17     39 (relating to theft and related offenses) in the commission
    18     of which a court determines a motor vehicle was essentially

     1     involved and where the person was a commercial driver at the
     2     time the violation occurred, except as described in
     3     subsection (e);

     5     Section 2.  This act shall take effect in 60 days.
