        INTRODUCED BY GREENLEAF, WOZNIAK, PUNT, MELLOW, BOSCOLA,
           KITCHEN, FONTANA, STOUT, D. WHITE, WONDERLING, KASUNIC,
           ERICKSON, TOMLINSON, LAVALLE, COSTA, O'PAKE, TARTAGLIONE,
           PIPPY AND STACK, MARCH 7, 2007

        REFERRED TO FINANCE, MARCH 7, 2007

                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     eligibility for limited early retirement.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8313 of Title 24 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8313.  Eligibility for limited early retirement.
     9     Notwithstanding any provisions of this title to the contrary,
    10  the following early retirement provisions shall be applicable to
    11  eligible members:
    12         (1)  Any member who, during the period of time from the
    13     effective date of this section through July 10, 1998:
    14             (i)  has credit for at least 30 eligibility points;
    15             (ii)  terminates school service; and
    16             (iii)  files an application for an annuity with an
    17         effective date of retirement not later than July 11,


     1         1998,
     2     shall be entitled to receive a maximum single life annuity
     3     calculated pursuant to section 8342 (relating to maximum
     4     single life annuity) without any reduction by virtue of an
     5     effective date of retirement which is under the
     6     superannuation age.
     7         (2)  Any member who, during the period of time from April
     8     1, 1999, through June 30, 1999:
     9             (i)  has credit for at least 30 eligibility points;
    10             (ii)  terminates school service; and
    11             (iii)  files an application for an annuity with an
    12         effective date of retirement not later than July 1, 1999,
    13     shall be entitled to receive a maximum single life annuity
    14     calculated pursuant to section 8342 without any reduction by
    15     virtue of an effective date of retirement which is under the
    16     superannuation age.
    17         (3)  Any member who, during the period of time from April
    18     1, 2007, through June 30, 2007:
    19             (i)  has credit for at least 30 eligibility points;
    20             (ii)  terminates school service; and
    21             (iii)  files an application for an annuity with an
    22         effective date of retirement not later than July 1, 2007,
    23     shall be entitled to receive a maximum single life annuity
    24     calculated pursuant to section 8342 without any reduction by
    25     virtue of an effective date of retirement which is under the
    26     superannuation age.
    27         (4)  Any member who, during the period of time from April
    28     1, 2008, through June 30, 2008:
    29             (i)  has credit for at least 30 eligibility points;
    30             (ii)  terminates school service; and

     1             (iii)  files an application for an annuity with an
     2         effective date of retirement not later than July 1, 2008,
     3     shall be entitled to receive a maximum single life annuity
     4     calculated pursuant to section 8342 without any reduction by
     5     virtue of an effective date of retirement which is under the
     6     superannuation age.
     7     Section 2.  Section 5308.2 of Title 71 is amended to read:
     8  § 5308.2.  Eligibility for limited early retirement.
     9     Notwithstanding any provisions of this title to the
    10  contrary[, any]:
    11         (1)  Any eligible member who, during the period of time
    12     from July 1, 1998, through June 30, 1999:
    13             [(1)] (i)  has credit for at least 30 eligibility
    14         points;
    15             [(2)] (ii)  terminates State service; and
    16             [(3)] (iii)  files an application for an annuity with
    17         an effective date of retirement not later than July 1,
    18         1999,
    19     shall be entitled to receive a maximum single life annuity
    20     calculated pursuant to section 5702 (relating to maximum
    21     single life annuity) without any reduction by virtue of an
    22     effective date of retirement which is under the
    23     superannuation age.
    24         (2)  Any eligible member who, during the period of time
    25     from July 1, 2007, through June 30, 2008:
    26             (i)  has credit for at least 30 eligibility points;
    27             (ii)  terminates State service; and
    28             (iii)  files an application for an annuity with an
    29         effective date of retirement not later than July 1, 2008,
    30     shall be entitled to receive a maximum single life annuity

     1     calculated pursuant to section 5702 without any reduction by
     2     virtue of an effective date of retirement which is under the
     3     superannuation age.
     4     Section 3.  This act shall take effect immediately.
