        INTRODUCED BY GREENLEAF, DINNIMAN, TOMLINSON, ERICKSON, COSTA,
           RAFFERTY, BOSCOLA, FONTANA, ORIE, EARLL, VANCE, O'PAKE,
           WOZNIAK, BROWNE, BAKER, PILEGGI AND STACK, FEBRUARY 12, 2007

        SENATOR GREENLEAF, JUDICIARY, AS AMENDED, MARCH 13, 2007

                                     AN ACT

     1  Amending the act of December 4, 1996 (P.L.893, No.141), entitled
     2     "An act providing for volunteer health services; limiting
     3     liability of a volunteer license holder; and requiring
     4     reports," further providing for license renewal, continuing
     5     education requirements and disciplinary and corrective
     6     measures.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 6 of the act of December 4, 1996
    10  (P.L.893, No.141), known as the Volunteer Health Services Act,
    11  is amended to read:
    12  Section 6.  License renewal; disciplinary and corrective
    13                 measures.
    14     (a)  Renewal term.--A volunteer license shall be subject to
    15  biennial renewal.
    16     (b)  Fee exemption.--Holders of volunteer licenses shall be
    17  exempt from renewal fees imposed by the appropriate licensing

    19     (c)  Continuing education.--Except as set forth in subsection


     1  (d), volunteer licensees HOLDERS OF VOLUNTEER LICENSES shall      <--
     2  comply with any continuing education requirements imposed by
     3  board rulemaking as a general condition of biennial renewal.
     4     (d)  Physicians.--Volunteer licensees who are physicians       <--
     5  shall complete a minimum of 20 credit hours of American Medical
     6  Association Physician's Recognition Award Category 2 activities
     7  during the preceding biennial period as a condition of biennial
     8  renewal and are otherwise exempt from any continuing education
     9  requirement imposed by section 910 of the act of March 20, 2002
    10  (P.L.154, No.13), known as the Medical Care Availability and
    11  Reduction of Error (Mcare) Act, or by board rulemaking.
    12     (D)  PHYSICIANS.--                                             <--
    13         (1)  HOLDERS OF VOLUNTEER LICENSES WHO ARE PHYSICIANS
    14     SHALL COMPLETE A MINIMUM OF 20 CREDIT HOURS OF AMERICAN
    15     MEDICAL ASSOCIATION PHYSICIAN'S RECOGNITION AWARD CATEGORY 2
    16     ACTIVITIES DURING THE PRECEDING BIENNIAL PERIOD AS A
    17     CONDITION OF BIENNIAL RENEWAL AND ARE OTHERWISE EXEMPT FROM
    18     ANY CONTINUING EDUCATION REQUIREMENT IMPOSED BY SECTION 910
    19     OF THE ACT OF MARCH 20, 2002 (P.L.154, NO.13), KNOWN AS THE
    20     MEDICAL CARE AVAILABILITY AND REDUCTION OF ERROR (MCARE) ACT,
    21     OR BY BOARD RULEMAKING.
    22         (2)  PHYSICIANS WHO ARE COVERED BY SECTION 10.2 AND HOLD
    23     AN UNRESTRICTED LICENSE TO PRACTICE MEDICINE SHALL COMPLETE
    24     THE CONTINUING MEDICAL EDUCATION REQUIREMENTS ESTABLISHED BY
    25     THE BOARDS UNDER SECTION 910 OF THE MEDICAL CARE AVAILABILITY
    26     AND REDUCTION OF ERROR (MCARE) ACT TO BE ELIGIBLE FOR RENEWAL
    27     OF THE UNRESTRICTED LICENSE.
    28     (e)  Disciplinary matters.--In the enforcement of
    29  disciplinary matters, holders of volunteer licenses shall be
    30  subject to those standards of conduct applicable to all

     2     Section 2.  This act shall take effect in 60 days              <--
