                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting children under the age of ten from
     3     riding in front seat of passenger vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 4581.1.  Child passenger in front seat.
     9     (a)  General rule.--Except as provided in subsection (b), no
    10  person shall operate a passenger car unless all passengers under
    11  the age of ten are seated in a seat behind the front seat if the
    12  passenger car is equipped with a middle or rear seat.
    13     (b)  Exception.--A person may operate a passenger vehicle
    14  with a child under the age of ten in the front seat if all
    15  middle and rear seat positions are occupied by children under
    16  the age of ten and the oldest child in the vehicle, other than
    17  the operator, is the child occupying the front seat.
    18     (c)  Penalty.--Any person who operates a passenger car in

     1  violation of this section commits a summary offense and shall,
     2  upon conviction, be sentenced to pay a fine of not more than
     3  $25.
     4     Section 2.  This act shall take effect in 60 days.
