                                     AN ACT

     1  Amending the act of June 27, 2006 (1st Sp.Sess., P.L.1873,
     2     No.1), entitled "An act providing for taxation by school
     3     districts, for the State funds formula, for tax relief in
     4     first class cities, for school district choice and voter
     5     participation, for other school district options and for a
     6     task force on school cost reduction; making an appropriation;
     7     prohibiting prior authorized taxation; providing for
     8     installment payment of taxes; restricting the power of
     9     certain school districts to levy, assess and collect taxes;
    10     and making related repeals," further providing for adoption
    11     of further referendum.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 332 of the act of June 27, 2006 (1st
    15  Sp.Sess., P.L.1873, No.1), known as the Taxpayer Relief Act, is
    16  amended by adding a subsection to read:
    17  Section 332.  Adoption of further referendum.

    19     (b.1)  2009 municipal election in certain third class
    20  counties.--A board of school directors in a county of the third
    21  class with a city of the third class having a population between
    22  40,000 and 41,000 as determined by the Bureau of the United

     1  States Census in the Department of Commerce in the 2000 Census
     2  shall submit a referendum question pursuant to subsection (b) to
     3  the electorate of the school district at the municipal election
     4  of 2009. The proposed tax rate shall be established by the board
     5  of school directors of the school district and shall equal the
     6  rate required to provide an exclusion for homestead property and
     7  farmstead property equal to the maximum exclusion under 53
     8  Pa.C.S. § 8586 (relating to limitations). Subsections (a)(2),
     9  (d), (e), (g), (h) and (i) shall apply to a referendum question
    10  held pursuant to this subsection. No school district shall seek
    11  to impose a tax pursuant to this subsection that is authorized
    12  under section 321(b).
