AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," increasing the maximum 4 annual State grants to county institution districts or their 5 successors for cost of child welfare programs; further 6 providing for the payment of the costs and expenses for the 7 care of the child; and placing a duty upon the Auditor 8 General to ascertain and certify certain costs. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 704.1(a)(4) and (g) of the act of June 12 13, 1967 (P.L.31, No.21), known as the Public Welfare Code, 13 amended or added July 9, 1976 (P.L.846, No.148) and August 5, 14 1991 (P.L.315, No.30), are amended to read: 15 Section 704.1. Payments to Counties for Services to 16 Children.--(a) The department shall reimburse county 17 institution districts or their successors for expenditures 18 incurred by them in the performance of their obligation pursuant 19 to this act and the act of December 6, 1972 (P.L.1464, No.333),
1 known as the "Juvenile Act," in the following percentages: 2 * * * 3 (4) [Fifty percent] Ninety percent of the actual cost of 4 care and support of a child placed by a county child welfare 5 agency or a child committed by a court pursuant to the act of 6 December 6, 1972 (P.L.1464, No.333), known as the "Juvenile 7 Act," to the legal custody of a public or private agency 8 approved or operated by the department other than those services 9 described in clause (2). The Auditor General shall ascertain the 10 actual expense for fiscal year 1974-1975 and each year 11 thereafter by the Department of Public Welfare for each of the 12 several counties and each city of the first class whose children 13 resident within the county or city of the first class directly 14 received the benefit of the Commonwealth's expenditure. The 15 Auditor General shall also ascertain for each Commonwealth 16 institution or facility rendering services to delinquent or 17 deprived children the actual average daily cost of providing 18 said services. The Auditor General shall certify to each county 19 and city of the first class the allocated Commonwealth 20 expenditures incurred on behalf of its children and notify the 21 Secretary of Public Welfare and each county and city of the 22 first class of same. 23 * * * 24 (g) The department shall, within forty-five days of each 25 calendar quarter, pay [fifty percent] ninety percent of the 26 department's share of the county institution district's or its 27 successor's estimated expenditures for that quarter. 28 * * * 29 Section 2.
