                                     AN ACT

     1  Prohibiting the Commonwealth from obtaining certification under
     2     the Federal REAL ID Act of 2005; and providing for the
     3     authority of the Governor and Attorney General to file
     4     certain legal challenges.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Pennsylvania
     9  REAL ID Act.
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "REAL ID Act of 2005."  Division B of the Emergency
    15  Supplemental Appropriations Act for Defense, the Global War on
    16  Terror and the Tsunami Relief, 2005 (Public Law 109-13, 119
    17  Stat. 302).


     1  Section 3.  Certification under the REAL ID Act of 2005.
     2     The Commonwealth shall not seek or otherwise apply for state
     3  certification under the REAL ID Act of 2005.
     4  Section 4.  Legal challenge.
     5     Either the Governor or the Attorney General may file an
     6  action in a court of competent jurisdiction to challenge the
     7  constitutionality or legality of the REAL ID Act of 2005.
     8  Section 5.  Effective date.
     9     This act shall take effect in 60 days.
