        AS REPORTED FROM COMMITTEE ON HEALTH AND HUMAN SERVICES, HOUSE
           OF REPRESENTATIVES, AS AMENDED, JUNE 17, 2008

                                     AN ACT

     1  Providing for copies of patient test results to be sent directly
     2     to patients.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Patient Test
     7  Result Information Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Diagnostic imaging services."  Services that include any of
    13  the following:
    14         (1)  Magnetic resonance imaging.

     1         (2)  Nuclear medicine.
     2         (3)  Angiography.
     3         (4)  Arteriography.
     4         (5)  Computerized axial tomography.
     5         (6)  Positron emission tomography.
     6         (7)  Digital vascular imaging.
     7         (8)  Bronchoscopy.
     8         (9)  Lymphangiography.
     9         (10)  Splenography.
    10         (11)  Ultrasound.
    11         (12)  EEG.
    12         (13)  EKG.
    13         (14)  Nerve conduction studies.
    14         (15)  Evoked potentials.
    15  Section 3.  Test results.
    16     An entity performing diagnostic imaging services with the
    17  exception of routine obstetrical ultrasounds used to monitor the
    18  development of a fetus in which no adverse medical condition is
    19  diagnosed, shall send directly to the patient a written copy OF   <--
    20  THE SUMMARY of the test results of diagnostic imaging services
    21  performed on the patient within five TEN days of sending the      <--
    22  test results to the patient's physician. PRESCRIBING PHYSICIAN.   <--
    23  THE WRITTEN COPY OF THE SUMMARY OF THE TEST RESULTS MAY BE SENT
    24  DIRECTLY TO THE PATIENT ELECTRONICALLY BY E-MAIL OR FACSIMILE.
    25  Section 4.  Effective date.
    26     This act shall take effect in 60 days.
