AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for application for certificate 3 of title; and providing for licensing cost for document 4 preparation. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 1103.1 of Title 75 of the Pennsylvania 8 Consolidated Statutes is amended by adding a subsection to read: 9 § 1103.1. Application for certificate of title. 10 * * * 11 (d.2) Licensing cost.--A licensed dealer contracted as an 12 issuing agent with the department may charge to the purchaser of 13 a vehicle, including a vehicle that the purchaser will title and 14 register outside of this Commonwealth, a licensing cost for 15 document preparation in accordance with section 1962 (relating 16 to licensing cost for document preparation) for the following: 17 (1) The actual cost to the dealer of the fees associated 18 with titling and registering the vehicle, including messenger
1 fees, notary fees and electronic transaction fees. 2 (2) Document preparation as a licensing cost permissible 3 pursuant to this title or the act of December 17, 1968 4 (P.L.1224, No.387), known as the Unfair Trade Practices and 5 Consumer Protection Law, and any regulations promulgated 6 under that act, which includes the preparation, completion, 7 collection and submission of any documents and fees 8 prescribed in this title, taxes payable by the purchaser and 9 any other information associated with the titling and 10 registering of a vehicle. 11 * * * 12 Section 2. Title 75 is amended by adding a section to read: 13 § 1962. Licensing cost for document preparation. 14 (a) Licensing cost for electronic document preparation.--A 15 dealer which provides electronic transaction services may impose 16 a maximum charge of $120 for document preparation services 17 provided under section 1103.1(d.2)(2) (relating to application 18 for certificate of title). 19 (b) Licensing cost for nonelectronic document preparation.-- 20 A dealer which does not provide electronic transaction services 21 may impose a maximum charge of $100 for document preparation 22 services provided under section 1103.1(d.2)(2). 23 (c) Adjustment of licensing cost for document preparation.-- 24 The licensing cost for electronic and nonelectronic document 25 preparation shall be adjusted annually, on a cumulative basis, 26 beginning with calendar year 2010, in accordance with the 27 Federal Consumer Price Index, calculated based on the previous 28 calendar year and effective upon the announcement by the United 29 States Department of Labor, Bureau of Labor Statistics or any 30 successor agency that makes the annual announcement. 1 adjustment which is less than 50¢ shall be rounded down to the 2 next lowest dollar amount, and any adjustment which is 50¢ or 3 greater shall be rounded up to the next highest dollar amount. 4 Section 3. This act shall take effect in 60 days. C28L75BIL/20080H2418B3529 - 3 -
