                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for eligibility and
     3     qualification requirements.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8703 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8703.  Eligibility and qualification requirements.
     9     (a)  Eligibility standards.--The following requirements shall
    10  be used to determine the eligibility of applicants for
    11  educational gratuity payments. The applicant shall be:
    12         (1)  Not less than 16 years of age nor more than 23 years
    13     of age.
    14         (2)  The child of an eligible disabled or deceased
    15     veteran.
    16         (3)  A resident of this Commonwealth for a period of five

     1     years immediately preceding the date the application was
     2     filed.
     3     (b)  Qualification determination.--The commission shall
     4  determine qualified applicants based on the following
     5  requirements:
     6         (1)  The applicant meets the requirements of subsection
     7     (a).
     8         (2)  The applicant is attending an approved educational
     9     institution.
    10         [(3)  The applicant demonstrates a financial need for the
    11     educational gratuity.]
    12     (c)  Appeal.--Any aggrieved applicant may appeal the decision
    13  of the commission to the Adjutant General under the provisions
    14  of Title 2 (relating to administrative law and procedure).
    15     Section 2.  This act shall take effect immediately.
