        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 2, 2008

                                     AN ACT

     1  Making appropriations to the Philadelphia Health and Education
     2     Corporation for the Colleges of Medicine, Public Health,
     3     Nursing and Health Professions and for continuation of
     4     pediatric services.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  (a)  The sum of $3,899,000 is hereby appropriated
     8  to the Philadelphia Health and Education Corporation for the
     9  College of Medicine for the fiscal year July 1, 2008, to June
    10  30, 2009, for instruction in the Doctor of Medicine program.
    11     (b)  The sum of $868,000 is hereby appropriated to the
    12  Philadelphia Health and Education Corporation for the Colleges
    13  of Medicine, Public Health, Nursing and Health Professions for
    14  the fiscal year July 1, 2008, to June 30, 2009, for the general
    15  maintenance of the Colleges of Medicine, Public Health and
    16  Nursing, including the Allied Health, Professions and Graduate
    17  Schools, and for student aid.
    18     (c)  The sum of $154,000 is hereby appropriated to the

     1  Philadelphia Health and Education Corporation for the fiscal
     2  year July 1, 2008, to June 30, 2009, for minority educational
     3  and recruitment programs.
     4     (d)  The sum of $712,000 is hereby appropriated to the
     5  Philadelphia Health and Education Corporation, for the fiscal
     6  year July 1, 2008, to June 30, 2009, for continued pediatric
     7  outpatient and inpatient treatment of severe physically
     8  disabling diseases.
     9     (e)  The sum of $74,000 is hereby appropriated to the
    10  Philadelphia Health and Education Corporation, for the fiscal
    11  year July 1, 2008, to June 30, 2009, for continued support of
    12  the handicapped children's clinic.
    13     (f)  The sum of $1,010,000 is hereby appropriated to the
    14  Philadelphia Health and Education Corporation, for the College
    15  of Medicine for the fiscal year July 1, 2008, to June 30, 2009,
    16  for operating expenses.
    17     Section 2.  (a)  Payments to the Philadelphia Health and
    18  Education Corporation on account of the appropriations provided
    19  in section 1(a), (b), (c) and (f) shall be made quarterly IN TWO  <--
    20  EQUAL PAYMENTS, THE FIRST PAYMENT BY SEPTEMBER 15 AND THE SECOND
    21  PAYMENT BY DECEMBER 15, by the Secretary of Education on the
    22  basis of costs during the fiscal year and shall be conditioned
    23  on continuing authority for inclusion on the Board of Trustees
    24  of the Philadelphia Health and Education Corporation of a
    25  minimum of five persons who are not elected officials and who
    26  are appointed by the Governor, the President pro tempore of the
    27  Senate, the Minority Leader of the Senate, the Speaker of the
    28  House of Representatives and the Minority Leader of the House of
    29  Representatives for terms of office coterminous with that of the
    30  respective appointing authority; and shall be further

     1  conditioned on these appointees receiving full voting rights as
     2  members of the board of trustees.
     3     (b)  Payments to the Philadelphia Health and Education
     4  Corporation on account of the appropriations APPROPRIATION        <--
     5  provided in section 1(d) and (e) shall be made by the Secretary   <--
     6  of Health in equal quarterly payments. SHALL BE MADE IN EQUAL     <--
     7  QUARTERLY PAYMENTS AND THE APPROPRIATION PROVIDED IN SECTION
     8  1(E) SHALL BE MADE IN TWO EQUAL PAYMENTS, THE FIRST PAYMENT BY
     9  SEPTEMBER 15 AND THE SECOND PAYMENT BY DECEMBER 15, BY THE
    10  SECRETARY OF HEALTH.
    11     Section 3.  (a)  The Philadelphia Health and Education
    12  Corporation shall provide full, complete and accurate
    13  information for the appropriations under section 1(a), (b), (c)
    14  and (f) as may be required by the Department of Education or the
    15  chairman or the minority chairman of the Appropriations
    16  Committee of the Senate or the chairman or the minority chairman
    17  of the Appropriations Committee of the House of Representatives.
    18     (b)  The Philadelphia Health and Education Corporation shall
    19  provide full, complete and accurate information for the
    20  appropriations under section 1(d) and (e) as may be required by
    21  the Department of Health or the chairman or the minority
    22  chairman of the Appropriations Committee of the Senate or the
    23  chairman or the minority chairman of the Appropriations
    24  Committee of the House of Representatives.
    25     Section 4.  The Philadelphia Health and Education Corporation
    26  for the Colleges of Medicine, Public Health, Nursing and Health
    27  Professions shall report its revenues and expenditures and
    28  present its financial statements in accordance with generally
    29  accepted accounting principles and procedures for educational
    30  institutions as set forth in the "Higher Education Finance

     1  Manual (1975)" and the "Commonwealth of Pennsylvania Budget
     2  Instructions for the State System of Higher Education, State-
     3  Related Universities and Non-State-Related Colleges and
     4  Universities."
     5     Section 5.  The trustees of the Philadelphia Health and
     6  Education Corporation for the Colleges of Medicine, Public
     7  Health, Nursing and Health Professions shall report on forms
     8  provided by the Department of Education to both the chairman and
     9  minority chairman of the Appropriations Committee of the Senate
    10  and the chairman and minority chairman of the Appropriations
    11  Committee of the House of Representatives by September 30, 2009,
    12  on how State-appropriated funds were expended for fiscal year
    13  2008-2009 to reduce the costs to Pennsylvania resident students
    14  or to provide services to Pennsylvania residents.
    15     Section 6.  This act shall take effect July 1, 2008, or
    16  immediately, whichever is later.
