AN ACT 1 Amending the act of February 9, 2004 (P.L.61, No.7), entitled 2 "An act providing for a residential neighborhood enhancement 3 program to be administered by the Department of Community and 4 Economic Development; and making an allocation of 5 appropriated funds," further providing for program 6 requirements and for rules and regulations; and repealing the 7 expiration date of the act. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 3(c) of the act of February 9, 2004 11 (P.L.61, No.7), known as the Elm Street Program Act, is amended 12 and the section is amended by adding a subsection to read: 13 Section 3. Elm Street Program. 14 * * * 15 (c) Program requirements.--The program shall: 16 (1) Provide basic grants for [a maximum of] five years
1 per project or upon approval by the department an additional 2 period of UP TO five years for administrative costs <-- 3 associated with the hiring of a professional Elm Street 4 Manager, who may serve as an assistant to the Main Street 5 Manager if a Main Street Program exists within the 6 municipality. 7 (2) Provide residential reinvestment grants for 8 infrastructure and structural improvements, including, but 9 not limited to, streets, street lights, trees, exteriors of 10 buildings and sidewalks or other pedestrian-oriented 11 features. 12 (3) Provide planning and development grants for: 13 (i) Marketing and promoting urban residential 14 living. 15 (ii) Leveraging additional private and public 16 investment. 17 (iii) Promoting home ownership and other housing 18 options. 19 (iv) Addressing social and economic concerns 20 including, but not limited to, crime, blight, employment 21 opportunities and public services and amenities. 22 (v) Achieving consistency, whenever appropriate, 23 with existing commercial and residential revitalization 24 efforts. 25 (VI) PROMOTING THE DEVELOPMENT OF TRADITIONAL <-- 26 NEIGHBORHOOD CONSUMER SERVICES AND GOODS, INCLUDING, BUT 27 NOT LIMITED TO, BANKING INSTITUTIONS, GROCERY STORES AND 28 PHARMACIES. 29 (4) Provide an assessment of the applying municipality's 30 need for the following: 20080H2233B3226 - 2 -
1 (i) The establishment of a neighborhood improvement 2 district as defined in the act of December 20, 2000 3 (P.L.949, No.130), known as the Neighborhood Improvement 4 District Act. 5 (ii) A review of local comprehensive plans and 6 zoning and other land use ordinances to foster the 7 viability of established residential neighborhoods, with 8 a balanced mix of commercial, civic, employment and 9 residential uses, with particular attention to a 10 diversity of housing options. 11 (iii) A review of educational and recreational 12 opportunities and facilities. 13 * * * 14 (i) Regulations.--The department shall adopt regulations to 15 authorize municipalities or their designees, upon the submission 16 of the appropriate applications and the approval of the 17 department, to reestablish an Elm Street program in a 18 neighborhood where a program had been previously established. 19 Section 2. Section 6 of the act is repealed: 20 [Section 6. Expiration of act. 21 This act shall expire June 30, 2011, unless it is reenacted 22 prior to that date.] 23 Section 3.
