                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for restriction on
     6     participation in extracurricular activities.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1317.4.  Restriction on Participation in
    13  Extracurricular Activities.--(a)  A school district shall
    14  suspend a student from participation in an extracurricular
    15  activity if the student is convicted or adjudicated delinquent
    16  of any offense under the act of April 14, 1972 (P.L.233, No.64),
    17  known as "The Controlled Substance, Drug, Device and Cosmetic
    18  Act." The length of the suspension shall be established by
    19  school policy.

     1     (b)  As used in this section, the term "extracurricular
     2  activity" means:
     3     (1)  An activity covered by the provisions of section 511
     4  which meets the following criteria:
     5     (i)  The activity is sponsored or approved by the board of
     6  school directors.
     7     (ii)  The activity is not offered for credit toward
     8  graduation.
     9     (iii)  The activity is conducted partially or entirely
    10  outside the regular instructional day schedule.
    11     (iv)  The activity is available to any student enrolled in a
    12  school within the school district who voluntarily elects to
    13  participate and be subject to the eligibility requirements of
    14  the activity.
    15     (2)  A school district's program of interscholastic
    16  athletics, including varsity sports, shall be deemed
    17  extracurricular in nature and shall include all activities
    18  relating to competitive sports contests, games, events or
    19  exhibitions involving individual students or teams of students
    20  of the school district whenever the activities occur between
    21  schools within a district or with schools outside the district.
    22     Section 2.  This act shall take effect in 60 days.
