                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the education registration plate;
     3     establishing the Technology in Education Fund; and providing
     4     for the distribution of annual use fees received from the
     5     registration of the education registration plate.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 75 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 1366.  Education registration plate.
    11     (a)  Plate.--The department, in consultation with the
    12  Department of Education, shall design and issue an education
    13  registration plate.
    14     (b)  Issuance.--The department shall issue the registration
    15  plate for a passenger car, motor home, trailer or truck with a
    16  registered gross weight of not more than 9,000 pounds.
    17     (c)  Fees.--
    18         (1)  An initial one-time fee of $30, which shall be in


     1     addition to the annual registration fee, shall be collected
     2     by the department for each plate issued under this section.
     3         (2)  An annual fee of $10, which shall be in addition to
     4     the annual registration fee, shall be collected by the
     5     department for each plate issued under this section in each
     6     subsequent year.
     7     (d)  Use of fee.--The fee paid under subsection (c) shall be
     8  distributed as follows:
     9         (1)  Twenty dollars of the initial one-time fee shall be
    10     deposited into the Technology in Education Fund.
    11         (2)  Ten dollars of the recurring fee shall be deposited
    12     into the Technology in Education Fund.
    13     Section 2.  Section 1905 of Title 75 is amended by adding a
    14  subsection to read:
    15  § 1905.  Payments to special funds.
    16     * * *
    17     (d)  Technology in Education Fund.--
    18         (1)  There is established a special account in the State
    19     Treasury which shall be known as the Technology in Education
    20     Fund. The purpose of the Technology in Education Fund is to
    21     pay for computer technology in the public schools.
    22         (2)  All moneys received under section 1366(d)(1)
    23     (relating to education registration plate) and all interest
    24     received on the moneys in the Technology in Education Fund
    25     shall be credited to the Technology in Education Fund.
    26         (3)  Subject to approval under paragraphs (5) and (6),
    27     all funds in the Technology in Education Fund are hereby
    28     annually appropriated to the Department of Education and
    29     shall be used for the purposes authorized under this
    30     subsection in accordance to the parameters set forth in

     1     paragraph (4).
     2         (4)  Funds shall be allocated to public school districts
     3     through a competitive grant review process established by the
     4     Department of Education as follows:
     5             (i)  A district receiving funds from the Technology
     6         in Education Fund in any given fiscal year shall be
     7         ineligible to receive further grants from the Technology
     8         in Education Fund for two subsequent fiscal years.
     9             (ii)  The Department of Education may establish
    10         matching requirements for districts receiving moneys from
    11         the Technology in Education Fund.
    12             (iii)  The application for a grant shall be made at
    13         such time and in such form as the Secretary of Education
    14         may require.
    15         (5)  Estimates of amounts to be expended under this
    16     subsection shall be submitted to the Governor by the
    17     Department of Education for his approval.
    18         (6)  The State Treasurer shall not honor any requisition
    19     for expenditures by the Department of Education in excess of
    20     estimates approved by the Governor under paragraph (5) or in
    21     excess of the amount available for the purposes for which the
    22     requisition was made, whichever is the lesser amount.
    23     Section 3.  This act shall take effect in 60 days.
