                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the offense of aggravated assault by
     3     vehicle; and prescribing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3732.1.  Aggravated assault by vehicle.
     9     (a)  Offense defined.--Any person who recklessly or with
    10  gross negligence causes serious bodily injury to another person
    11  while engaged in the violation of any law of this Commonwealth
    12  or municipal ordinance applying to the operation or use of a
    13  vehicle or to the regulation of traffic, except section 3802
    14  (relating to driving under the influence of alcohol or
    15  controlled substance) when the violation under that section is
    16  the cause of the serious bodily injury, commits a felony of the
    17  third degree.


     1     (b)  Definitions.--As used in this section, "serious bodily
     2  injury" means any bodily injury which creates a substantial risk
     3  of death or which causes serious, permanent disfigurement or
     4  protracted loss or impairment of the function of any bodily
     5  member or organ.
     6     Section 2.  This act shall take effect in 60 days.
