                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," prohibiting certain unsafe operation
     6     of school buses.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1361.1.  Unsafe Operation of School Buses.--(a)  The
    13  consumption of food or beverage or use of cellular or other
    14  wireless telephones by school bus drivers while operating a
    15  school bus is prohibited.
    16     (b)  The prohibition contained in subsection (a) shall not
    17  apply when the school bus is parked in a safe area off a
    18  trafficway as defined in 75 Pa.C.S. § 102 (relating to

     1  definitions) or in an emergency situation.
     2     (c)  Penalty.--A person who violates this section commits a
     3  summary offense and shall, upon conviction, pay a fine of one
     4  hundred dollars ($100). The fine shall be three hundred dollars
     5  ($300) if the violation causes a vehicular accident.
     6     Section 2.  This act shall take effect in 60 days.
