AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, in juvenile matters,
3 further providing for disposition of delinquent child.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 6352 of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 6352. Disposition of delinquent child.

10 (a.1) Group assaults.--If the child is found to be
11 delinquent for conduct which if committed by an adult would
12 constitute simple assault or aggravated assault as defined under
13 18 Pa.C.S. § 2701 (relating to simple assault) or 2702 (relating
14 to aggravated assault) and the conduct was committed by the
15 child acting in concert with two or more other individuals who
16 aided or encouraged the child's conduct, the court shall make
17 one of the following orders of disposition:
18 (1) Committing the child to an institution, youth
1 development center, camp or other facility for delinquent
2 children operated under the direction or supervision of the
3 court or other public authority and approved by the
4 Department of Public Welfare.
5 (2) If the child is 12 years of age or older, committing
6 the child to an institution operated by the Department of
7 Public Welfare.

9 Section 2. This act shall take effect in 60 days.
