                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing, in community
     6     colleges, for tuition and for reimbursement of payments by
     7     the Commonwealth.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1908-A(a) of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949, added
    12  July 1, 1985 (P.L.103, No.31), is amended to read:
    13     Section 1908-A.  Tuition.--(a)  The normal tuition charged by
    14  each community college shall be an amount fixed by the board of
    15  trustees of the community college, in accordance with policies,
    16  standards, rules and regulations of the State Board of
    17  Education, determined by apportioning among the students
    18  enrolled in such college [not more than] an amount equal to one-
    19  third of its annual operating costs.

     1     Section 2.  Section 1913-A(b)(1) of the act, amended July 13,
     2  2005 (P.L.226, No.46), is amended to read:
     3     Section 1913-A.  Financial Program; Reimbursement of
     4  Payments.--* * *
     5     (b)  (1)  The Commonwealth shall pay to a community college
     6  on behalf of the sponsor on account of its operating costs
     7  during the fiscal year from funds appropriated for that purpose
     8  an amount equal to:
     9     (i)  for the 1993-1994 fiscal year through the 2000-2001
    10  fiscal year, the lesser of such college's variable State share
    11  ceiling as determined in clause (1.3) or such college's
    12  equivalent full-time student reimbursement as determined in
    13  clause (1.4);
    14     (ii)  for the 2001-2002 fiscal year through the 2004-2005
    15  fiscal year, the college's equivalent full-time student
    16  reimbursement as determined in clause (1.4);
    17     (iii)  for the 2005-2006 fiscal year, the college's payment
    18  as determined in clause (1.5); [and]
    19     (iv)  for the 2006-2007 fiscal year [and each fiscal year]
    20  thereafter, the college's payment as determined in clause
    21  (1.6)[.]; and
    22     (v)  for the 2007-2008 fiscal year and each fiscal year
    23  thereafter, one-third of the community college's annual
    24  operating costs.

    26     Section 3.  The amendment of section 1908-A(a) of the act
    27  shall apply to the 2007-2008 fiscal year and each fiscal year
    28  thereafter.
    29     Section 4.  This act shall take effect in 60 days.
