                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for free parking for hybrid and
     3     alternative fuel vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6301 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6301.  Prosecutions under local ordinances superseded by
     9             title.
    10     (a)  General rule.--Except for parking violations, when the
    11  same conduct is proscribed under this title and a local
    12  ordinance, the charge shall be brought under this title and not
    13  under the local ordinance. Prosecutions brought under any local
    14  ordinance, rule or regulation, which are based on a violation
    15  for which there is a specific penalty provided in this title,
    16  except for parking violations, shall be deemed as having been
    17  brought under this title and the assessment and disposition of
    18  the fines and forfeitures shall be so governed. Local ordinances

     1  relating to parking shall prescribe fines for violations and may
     2  authorize the payment of penalties in lieu of fines and costs
     3  under prescribed conditions.
     4     (b)  Free parking for hybrid and alternative fuel vehicles.--
     5  Local ordinances related to parking shall grant free on-street
     6  parking for hybrid and alternative fuel vehicles displaying a
     7  "Green is Clean" decal. The department shall furnish a "Green is
     8  Clean" decal to hybrid and alternative fuel vehicle owners upon
     9  application of the owner together with proof satisfactory to the
    10  department that the vehicle is a hybrid or alternative fuel
    11  vehicle. The decal is nontransferable and must be displayed next
    12  to the inspection sticker of the hybrid or alternative fuel
    13  vehicle. This subsection shall apply to hybrid and alternative
    14  fuel vehicles as defined under section 2 of the act of November
    15  29, 2004 (P.L.1376, No.178), known as the Alternative Fuels
    16  Incentive Act.
    17     Section 2.  This act shall take effect in 60 days.
