           AMENDED, JUNE 29, 2007

                                     AN ACT

     1  Making appropriations from restricted revenue accounts within     <--
     2     the State Gaming Fund to the Pennsylvania Gaming Control
     3     Board, the Department of Revenue, the Pennsylvania State
     4     Police and the Attorney General.
     5  MAKING APPROPRIATIONS FROM THE RESTRICTED REVENUE ACCOUNTS        <--
     6     WITHIN THE STATE GAMING FUND AND FROM THE STATE GAMING FUND
     7     TO THE PENNSYLVANIA GAMING CONTROL BOARD, THE DEPARTMENT OF
     8     REVENUE, THE PENNSYLVANIA STATE POLICE AND THE ATTORNEY
     9     GENERAL FOR THE FISCAL YEAR BEGINNING JULY 1, 2007, TO JUNE
    10     30, 2008, AND FOR THE PAYMENT OF BILLS INCURRED AND REMAINING
    11     UNPAID AT THE CLOSE OF THE FISCAL YEAR ENDING JUNE 30, 2007.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  State Gaming Fund.--The following sums set forth   <--
    15  in this act, or as much thereof as maybe necessary, are hereby
    16  appropriated from the State Gaming Fund restricted revenue
    17  accounts under 4 Pa.C.S. § 1401 (relating to slot machine
    18  licensee deposits) to the hereinafter named agencies of the
    19  Executive Department for the purposes set forth herein for the
    20  fiscal year beginning July 1, 2007, and for the payment of bills
    21  incurred and remaining unpaid at the close of the fiscal year

     1  ending June 30, 2006.
     2     Section 2.  Pennsylvania Gaming
     3  Control Board.--The following amounts
     4  are appropriated to the Pennsylvania
     5  Gaming Control Board:                      Federal       State 
     6     For the salaries, wages and all
     7  necessary expenses for the proper
     8  operation and administration of the
     9  Pennsylvania Gaming Control Board.
    10             State appropriation........                31,266,000
    11     Section 3.  Attorney General.--The
    12  following amounts are appropriated to
    13  the Attorney General:                      Federal       State 
    14     For the salaries, wages and all
    15  necessary expenses of the Attorney
    16  General related to the Pennsylvania
    17  Race Horse Development and Gaming Act.
    18             State appropriation........                   799,000
    19     Section 4.  Department of
    20  Revenue.--The following amounts are
    21  appropriated to the Department of
    22  Revenue:                                   Federal       State 
    23     For the salaries, wages and all
    24  necessary expenses of the Department
    25  of Revenue related to the Pennsylvania
    26  Race Horse Development and Gaming Act.

    28     Section 5.  Pennsylvania State

     8     Section 6.  This act shall take effect July 1, 2007, or
     9  immediately, whichever is later.

    12  SECTION 101.  SHORT TITLE.
    13     THIS ACT SHALL BE KNOWN AND MAY BE CITED AS THE GAMING
    14  CONTROL APPROPRIATION ACT OF 2007.

    16                        STATE GAMING CONTROL
    17                    RESTRICTED REVENUE ACCOUNTS
    18     SECTION 301.  STATE GAMING FUND.--THE FOLLOWING AMOUNTS SET
    19  FORTH IN THIS PART, OR AS MUCH THEREOF AS MAY BE NECESSARY, ARE
    20  HEREBY APPROPRIATED FROM THE STATE GAMING FUND RESTRICTED
    21  REVENUE ACCOUNTS UNDER 4 PA.C.S. § 1401 (RELATING TO SLOT
    22  MACHINE LICENSEE DEPOSITS) TO THE AGENCIES OF THE EXECUTIVE
    23  DEPARTMENT NAMED IN THIS PART FOR THE PURPOSES SET FORTH FOR THE
    24  FISCAL YEAR BEGINNING JULY 1, 2007, AND FOR THE PAYMENT OF BILLS
    25  INCURRED AND REMAINING UNPAID AT THE CLOSE OF THE FISCAL YEAR

    14  EXPENSES OF THE PENNSYLVANIA STATE POLICE RELATED
    15  TO 4 PA.C.S. PT. II (RELATING TO GAMING).

    18                         STATE GAMING FUND
    19     SECTION 501.  STATE GAMING FUND.--THE FOLLOWING AMOUNTS SET
    20  FORTH IN THIS PART, OR AS MUCH THEREOF AS MAY BE NECESSARY, ARE
    21  HEREBY APPROPRIATED FROM THE STATE GAMING FUND TO THE AGENCIES
    22  OF THE EXECUTIVE DEPARTMENT NAMED IN THIS PART FOR THE PURPOSES
    23  SET FORTH FOR THE FISCAL YEAR BEGINNING JULY 1, 2007, AND FOR

    26     SECTION 502.  PENNSYLVANIA GAMING CONTROL

    29     FOR THE SALARIES, WAGES AND ALL NECESSARY
    30  EXPENSES FOR THE PROPER OPERATION AND

     1  ADMINISTRATION OF THE PENNSYLVANIA GAMING CONTROL
     2  BOARD. THIS APPROPRIATION INCLUDES $7,409,000 FROM
     3  THE RESTRICTED REVENUE ACCOUNT ESTABLISHED IN THE
     4  STATE GAMING FUND FOR FEES AND OTHER REVENUES
     5  COLLECTED BY THE BOARD.
     6             STATE APPROPRIATION....................    29,984,000
     7     SECTION 503.  LOAN.--UNRESTRICTED FUNDS APPROPRIATED TO THE
     8  PENNSYLVANIA GAMING CONTROL BOARD UNDER THIS PART IN THE AMOUNT
     9  OF $22,575,000 SHALL CONSTITUTE A LOAN AND SHALL BE REPAID IN
    10  THE MANNER SET FORTH IN SECTION 1720-G OF THE ACT OF APRIL 9,
    11  1929 (P.L.343, NO.176), KNOWN AS THE FISCAL CODE. THE BOARD
    12  SHALL DEFER ASSESSING SLOT MACHINE LICENSEES FOR REPAYMENT UNTIL
    13  SUCH TIME AS 11 SLOT MACHINE LICENSES HAVE BEEN ISSUED AND 11
    14  LICENSED GAMING ENTITIES HAVE COMMENCED THE OPERATION OF SLOT
    15  MACHINES.
    16                              PART VII
    17                      MISCELLANEOUS PROVISIONS
    18     SECTION 701.  TRANSFERS PROHIBITED.--THERE IS NO AUTHORITY
    19  FOR THE STATE TREASURER, THE SECRETARY OF THE BUDGET, THE
    20  SECRETARY OF REVENUE OR THE PENNSYLVANIA GAMING CONTROL BOARD TO
    21  TRANSFER ANY MONEYS WITHIN OR BETWEEN THE APPROPRIATIONS IN PART
    22  III AND PART V OF THIS ACT.
    23     SECTION 702.  EFFECTIVE DATE.--THIS ACT SHALL TAKE EFFECT
    24  JULY 1, 2007, OR IMMEDIATELY, WHICHEVER IS LATER.
