AN ACT
1 Amending Title 51 (Military Affairs) of the Pennsylvania
2 Consolidated Statutes, providing for loan interest
3 forgiveness for certain active duty military personnel.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 7316 of Title 51 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 7316. Maximum rates of interest and scheduling of debts.

10 (d.1) Loan interest forgiveness.--Upon request, on forms
11 provided by the agency, loans administered by the Pennsylvania
12 Higher Education Assistance Agency under this section shall be
13 deferred for active duty members of the armed forces of the
1 United States described in subsection (a) for the period
2 commencing with the time of active duty call-up for a national
3 or State emergency, other than active duty for training, and
4 ending six months after the return to inactive duty or reserve
5 duty status. All interest accruing on loans deferred pursuant to
6 this subsection shall be paid by the Pennsylvania Higher
7 Education Assistance Agency provided that the student remains in
8 compliance with this chapter and other applicable conditions of
9 the loan agreement.

11 Section 2. The addition of 51 Pa.C.S. § 7316(d.1) shall
12 apply to armed forces personnel who were called to active duty
13 after September 11, 2001.
14 Section 3. This act shall take effect immediately.
