           OCTOBER 23, 2007

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, providing for vouchers for licenses.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 30 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 2716.  Vouchers for licenses and permits.
     8     (a)  General rule.--The commission may make available, at its
     9  offices and through its issuing agents, vouchers for licenses
    10  and permits that may be purchased on behalf of a third party.
    11  The voucher shall be in the format prescribed by the commission
    12  and shall contain the following information:
    13         (1)  A voucher number.
    14         (2)  The identifying number of the issuing agent.
    15         (3)  The type of license or permit for which the voucher


     1     may be redeemed.
     2         (4)  The date of issuance.
     3         (5)  The date of expiration.
     4     (b)  Fees.--A person purchasing a voucher shall pay the fees
     5  for the type of license or permit being purchased and the
     6  issuing agent fee as provided in section 2715 (relating to
     7  license, permit and issuing agent fees) unless otherwise exempt
     8  from such fees under this title.
     9     (c)  Redemption.--The voucher shall only be redeemed for the
    10  type of license or permit indicated on the voucher and for which
    11  the applicable fees have been paid by the voucher purchaser.
    12  Vouchers shall be redeemed prior to their expiration date. No
    13  issuing agent fee shall be paid at the time of redemption. A
    14  voucher shall be redeemed by any issuing agent regardless of
    15  where the voucher was purchased. At the time of redemption, the
    16  bearer of a voucher shall establish that he meets the
    17  eligibility requirements for the type of license indicated on
    18  the voucher, and the issuing agent that redeems the voucher
    19  shall secure positive proof of identification, residency and age
    20  from the bearer.
    21     (d)  Restrictions.--The bearer of a voucher is subject to all
    22  restrictions relating to the issuance, denial or revocation of a
    23  license or permit provided in this title or any other title, law
    24  or regulation. A voucher does not constitute a fishing license
    25  or permit, and it is unlawful to use a voucher in lieu of a
    26  fishing license or permit.
    27     (e)  Regulations.--The commission may promulgate regulations
    28  to implement this section.
    29     (f)  Penalties.--Any person violating this section commits a   <--

     1     (F)  PENALTIES.--                                              <--
     2         (1)  ANY PERSON WHO VIOLATES THIS SECTION COMMITS A
     3     SUMMARY OFFENSE OF THE FIRST DEGREE. ANY PERSON WHO COMMITS A
     4     second or subsequent violation of this section in a 12-month
     5     period commits a misdemeanor of the second degree.
     6         (2)  ANY PERSON WHO VIOLATES ANY REGULATION PROMULGATED    <--
     7     UNDER THIS SECTION COMMITS A SUMMARY OFFENSE OF THE SECOND
     8     DEGREE.
     9     Section 2.  This act shall take effect in 60 days.             <--
