                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for reimbursement
     6     for costs related to school crossing guards.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 2541.1.  Payments on Account of School Crossing
    13  Guards.--(a)  School districts shall be reimbursed by the
    14  Commonwealth for the amount equal to the cost of providing
    15  school crossing guards for each school year school districts
    16  incur the cost of school crossing guards. The amount that the
    17  Commonwealth shall reimburse a school district shall be
    18  determined pursuant to the provisions of this article.


     1     (b)  The crossing guards in a school district within a third
     2  class city shall be hired and shall have the duties as provided
     3  for in section 2010 of the act of June 23, 1931 (P.L.932,
     4  No.317), known as "The Third Class City Code."
     5     (c)  The crossing guards within a borough shall be hired and
     6  shall have the duties provided for in section 1127 of the act of
     7  February 1, 1966 (1965 P.L.1656, No.581), known as "The Borough
     8  Code."
     9     (d)  The crossing guards within a second class township shall
    10  be hired and shall have the duties as provided for in section
    11  1915 of the act of May 1, 1933 (P.L.103, No.69), known as "The
    12  Second Class Township Code."
    13     (e)  The crossing guards within a first class township shall
    14  be hired and shall have the duties as provided for in section
    15  1416 of the act of June 24, 1931 (P.L.1206, No.331), known as
    16  "The First Class Township Code."
    17     (f)  In a municipality other than provided for by subsections
    18  (b), (c), (d) and (e), the school district located within the
    19  municipality shall notify the police department or other law
    20  enforcement agency that administers traffic control and
    21  enforcement of the hiring of school crossing guards and shall
    22  request appropriate training for school crossing guards. The
    23  school district shall pay the cost of such training.
    24     (g)  School crossing guards shall be authorized only in the
    25  management of traffic and pedestrians in and around areas
    26  identified by the police department or other law enforcement
    27  agency that manages traffic control and enforcement and the
    28  school district superintendent or his or her designees, pursuant
    29  to section 2010(b) of "The Third Class City Code," section
    30  1127(b) of "The Borough Code," section 1416(b) of "The First

     1  Class Township Code" and section 1915(b) of "The Second Class
     2  Township Code."
     3     Section 2.  This act shall take effect in 60 days.
