                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for an automobile insurance discount for
     3     students who meet certain criteria.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1799.8.  Good student discount.
     9     (a)  General rule.--A company authorized to write private
    10  passenger automobile insurance within this Commonwealth shall
    11  provide a premium discount for each motor vehicle on a policy
    12  under which a named insured is 25 years of age or younger and
    13  has maintained a 3.0 academic average or better. This discount
    14  shall apply to all coverages for all policy periods beginning on
    15  or after January 1, 2007, and shall be approved by the Insurance
    16  Commissioner as part of the insurer's rate filing. The discount

     1  shall not be less than 15%. The discount is contingent on the
     2  driver being:
     3         (1)  Unmarried.
     4         (2)  Enrolled as a full-time student in:
     5             (i)  High school.
     6             (ii)  Academic courses in a college or university.
     7             (iii)  Vocational-technical school.
     8         (3)  An honor student where the scholastic records for
     9     the immediately preceding quarter, semester or comparable
    10     segment show that the driver:
    11             (i)  ranks scholastically in the upper 20% of the
    12         class;
    13             (ii)  has a "B" average or better;
    14             (iii)  has a 3.0 academic average or better; or
    15             (iv)  is on the dean's list or honor roll.
    16         (4)  A driver whose use of the automobile is considered
    17     by the insurer in determining the applicable classification.
    18     (b)  Proof.--Proof of meeting the requirements for the
    19  discount provided by this section shall be provided annually to
    20  the insurer by the insured student or policyholder upon forms as
    21  prescribed by the Insurance Commissioner.
    22     (c)  Limitations.--An insurer shall not be required to offer
    23  the premium reduction provided in subsection (a) to a driver at
    24  any time within a period of three years prior to the beginning
    25  of the policy year during which that reduction is otherwise
    26  required if any of the following apply:
    27         (1)  The driver has been involved in any motor vehicle
    28     accident in which that driver has been determined to have
    29     been at fault.
    30         (2)  The driver has been finally convicted of, pleaded

     1     nolo contendere to or been found to have committed a
     2     delinquent act constituting any of the following offenses:
     3             (i)  Any serious traffic offense described in
     4         Subchapter B of Chapter 37 (relating to serious traffic
     5         offenses).
     6             (ii)  Any traffic offense for which three or more
     7         points have been assessed pursuant to section 1535
     8         (relating to schedule of convictions and points).
     9             (iii)  Any felony or any offense prohibited pursuant
    10         to section 13 of the act of April 14, 1972 (P.L.233,
    11         No.64), known as The Controlled Substance, Drug, Device
    12         and Cosmetic Act.
    13         (3)  The driver's license has been suspended for refusal
    14     to submit to chemical tests pursuant to section 1547(b)
    15     (relating to chemical testing to determine amount of alcohol
    16     or controlled substance) and that suspension, if appealed,
    17     has not been reversed.
    18     Section 2.  This act shall take effect in 60 days.
