AN ACT 1 Amending Titles 24 (Education) and 71 (State Government) of the 2 Pennsylvania Consolidated Statutes, providing for special 3 supplemental annuities for certain annuitants. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 24 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 8348.8. Special supplemental annuities for certain 9 annuitants. 10 (a) Benefits.--Commencing with the first monthly annuity 11 payment after the conditions of subsection (c) are satisfied, 12 any eligible benefit recipient as defined in subsection (e) 13 shall be entitled to receive an additional monthly supplemental 14 annuity from the system as provided for in subsection (b). This 15 shall be in addition to the supplemental annuities provided for
1 in sections 8348 (relating to supplemental annuities), 8348.1 2 (relating to additional supplemental annuities), 8348.2 3 (relating to further additional supplemental annuities), 8348.3 4 (relating to supplemental annuities commencing 1994), 8348.5 5 (relating to supplemental annuities commencing 1998) and 8348.7 6 (relating to supplemental annuities commencing 2003) and the 7 special supplemental postretirement adjustments provided for in 8 sections 8348.4 (relating to special supplemental postretirement 9 adjustment) and 8348.6 (relating to supplemental annuities 10 commencing 2002). 11 (b) Amount and duration of special supplemental annuity.-- 12 The amount of the special supplemental annuity shall equal 5% of 13 the monthly annuity payment on the effective date of this 14 section. There shall be four additional 5% increases, one in 15 each of the next four years, in accordance with the terms and 16 conditions of this section. The payment shall be made 17 automatically. 18 (c) Certification of actuaries.--The actuary or actuaries of 19 the system must certify that sufficient reserves exist in the 20 fund to allow for payment of the special supplemental annuities 21 without requiring employer contributions to the fund and to 22 ensure that these adjustments can be made without any added cost 23 to taxpayers. The board shall transmit notice of the 24 certification under this subsection to the Legislative Reference 25 Bureau for publication in the Pennsylvania Bulletin. 26 (d) Benefits to beneficiaries or survivors.--No special 27 supplemental annuity provided under this section shall be 28 payable to the beneficiary or survivor annuitant of a member who 29 died before December 31, 2007. 30 (e) Eligible benefit recipient.--As used in this section, 20070H0350B0400 - 2 -
1 "eligible benefit recipient" means a person who is receiving a 2 superannuation, withdrawal or disability annuity on June 30, 3 2001. 4 Section 2. Title 71 is amended by adding a section to read: 5 § 5708.9. Special supplemental annuities for certain 6 annuitants. 7 (a) Benefits.--Commencing with the first monthly annuity 8 payment after the conditions of subsection (c) are satisfied, 9 any eligible benefit recipient as defined in subsection (e) 10 shall be entitled to receive an additional monthly supplemental 11 annuity from the system as provided for in subsection (b). This 12 shall be in addition to the supplemental annuities provided for 13 in sections 5708 (relating to supplemental annuities), 5708.1 14 (relating to additional supplemental annuities), 5708.2 15 (relating to further additional supplemental annuities), 5708.3 16 (relating to supplemental annuities commencing 1994), 5708.5 17 (relating to supplemental annuities commencing 1998) and 5708.7 18 (relating to supplemental annuities commencing 2003) and the 19 special supplemental postretirement adjustments provided for in 20 sections 5708.4 (relating to special supplemental postretirement 21 adjustment) and 5708.8 (relating to special supplemental 22 postretirement adjustment of 2002). 23 (b) Amount and duration of special supplemental annuity.-- 24 The amount of the special supplemental annuity shall equal 5% of 25 the monthly annuity payment on the effective date of this 26 section. This act shall apply as follows: 17 (1) The addition of 24 Pa.C.S. § 8348.8 shall apply upon 18 publication of the notice under 24 Pa.C.S § 8348.8(c). 19 (2) The addition of 71 Pa.C.S. § 5708.9 shall apply upon 20 publication of the notice under 71 Pa.C.S. § 5708.9(c). 21 Section 4.
