AN ACT
1 Prohibiting smoking in State parks; providing for duties of the
2 Environmental Quality Board; and imposing a penalty.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the Smoke Free
7 State Parks Act.
8 Section 2. Definitions.
9 The following words and phrases when used in this act shall
10 have the meanings given to them in this section unless the
11 context clearly indicates otherwise:
12 "Person." A natural person.
13 "Smoking." The carrying by a person of a lighted cigarette,
14 cigar, pipe or other lighted smoking device.
15 Section 3. Prohibition.
16 No person shall engage in smoking on State park property.
17 Section 4. Regulations.
1 The Environmental Quality Board shall establish rules and
2 regulations as it may deem necessary to carry out the provisions
3 of this act.
4 Section 5. Penalty.
5 A person who violates this act commits a summary offense and
6 shall, upon conviction, be sentenced to pay a fine of $50.
7 Section 6. Effective date.
8 This act shall take effect in 60 days.
