AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for
3 limitations on damages in cases of sovereign and governmental
4 immunity.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Sections 8528(c) and 8553(c) of Title 42 of the
8 Pennsylvania Consolidated Statutes are amended by adding
9 paragraphs to read:
10 § 8528. Limitations on damages.

12 (c) Types of damages recoverable.--Damages shall be
13 recoverable only for:

15 (4.1) Loss of the right, growing out of the parent-child
16 relationship, which parent and child have respectively to the
17 society, companionship and affection of each other in their
18 life together.

4 (c) Types of losses recognized.--Damages shall be
5 recoverable only for:

7 (4.1) Loss of the right, growing out of the parent-child
8 relationship, which parent and child have respectively to the
9 society, companionship and affection of each other in their
10 life together.

12 Section 2. The addition of 42 Pa.C.S. §§ 8528(c)(4.1) and
13 8553(c)(4.1) shall apply to causes of action which arise on or
14 after the effective date of this section.
15 Section 3. This act shall take effect in 60 days.
