AN ACT 1 Amending the act of December 7, 1982 (P.L.784, No.225), 2 entitled, as amended, "An act relating to dogs, regulating 3 the keeping of dogs; providing for the licensing of dogs and 4 kennels; providing for the protection of dogs and the 5 detention and destruction of dogs in certain cases; 6 regulating the sale and transportation of dogs; declaring 7 dogs to be personal property and the subject of theft; 8 providing for the abandonment of animals; providing for the 9 assessment of damages done to animals; providing for payment 10 of damages by the Commonwealth in certain cases and the 11 liability of the owner or keeper of dogs for such damages; 12 imposing powers and duties on certain State and local 13 officers and employees; providing penalties; and creating a 14 Dog Law Restricted Account," further providing for the 15 definition of "service dog" and for service dogs. 16 The General Assembly of the Commonwealth of Pennsylvania 17 hereby enacts as follows: 18 Section 1. The definition of "service dog" in section 102 of 19 the act of December 7, 1982 (P.L.784, No.225), known as the Dog 20 Law, amended December 11, 1996 (P.L.943, No.151), is amended to 21 read: 22 Section 102. Definitions. 23 The following words and phrases when used in this act shall
1 have, unless the context clearly indicates otherwise, the 2 meanings given to them in this section: 3 * * * 4 "Service dog." Any dog which has been trained as a guide 5 dog, signal dog or has been or is currently being trained to do 6 work or perform tasks for the benefit of an individual with a 7 disability, including, but not limited to, guiding individuals 8 with impaired vision, alerting individuals with impaired hearing 9 to intruders or sounds, pulling a wheelchair or fetching dropped 10 items. 11 * * * 12 Section 2. Section 602 heading and subsection (c) of the 13 act, amended December 11, 1996 (P.L.943, No.151), are amended to 14 read: 15 Section 602. Dogs used for law enforcement; service dogs. 16 * * * 17 (c) Illegal to deny facilities or service due to police dog 18 or service dog use.--It shall be unlawful for the proprietor, 19 manager or employee of a theater, hotel, motel, restaurant or 20 other place of entertainment, amusement or accommodation to 21 refuse, withhold from or deny to any person, due to the use of a 22 service dog which has been trained or which is currently 23 undergoing training by a certified trainer or a working police 24 dog used by any State or county or municipal police or sheriff's 25 department or agency, either directly or indirectly, any of the 26 accommodations, advantages, facilities or privileges of the 27 theater, hotel, motel, restaurant or other place of public 28 entertainment, amusement or accommodation.
