                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for classroom placement of
     6     twins.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1320.  Classroom Placement of Twins or Higher Order
    13  Multiples.--A parent or guardian of twins or higher order
    14  multiples may request that the pupils be placed in the same or
    15  separate classrooms, if they are in the same grade level and at
    16  the same public school. The public school may recommend
    17  classroom placement to the parents and provide professional
    18  education advice to the parents to assist them in making the
    19  best decision for the pupils' education. A public school shall


     1  provide the placement provided by the parent or guardian, unless
     2  there is no classroom space available to accommodate the request
     3  or the school board makes a classroom placement determination
     4  following the school principal's request according to this
     5  section. The parent or guardian may request the classroom
     6  placement no later than fourteen (14) days after the first day
     7  of each school year or fourteen (14) days after the first day of
     8  attendance of the pupils if the pupils are enrolled in the
     9  school after the school year commences. At the end of the
    10  initial grading period, if the school principal, in consultation
    11  with the pupils' classroom teachers, determines the requested
    12  classroom placement is disruptive to the school, the school
    13  principal may request the school board determine the children's
    14  classroom placement. As used in this section, the term "higher
    15  order multiples" shall mean triplets, quadruplets, quintuplets
    16  or more.
    17     Section 2.  This act shall take effect in 60 days.
