SENATE BILL

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," requiring courses of instruction in
     6     the safe driving of motor vehicles in public secondary
     7     schools; and making editorial changes.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1519(a) of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949,
    12  amended October 21, 1965 (P.L.601, No.312), is amended to read:
    13     Section 1519.  Teaching of Safe Driving of Motor Vehicles.--
    14     (a)  Any school district may provide for the teaching of safe
    15  driving of motor vehicles in the elementary [and secondary]
    16  schools of the district [or in the secondary schools only,] in
    17  accordance with the standardized program established by the
    18  Department of [Public Instruction.] Education. A school district
    19  shall provide for the teaching of safe driving of motor vehicles
    20  in the secondary schools of the district in accordance with the

     1  standardized program established by the Department of Education.
     2  In the case of pupils under the age of sixteen (16) years, such
     3  instruction shall be limited to class room instruction by those
     4  who shall possess the qualifications prescribed by the State
     5  Board of Education. In the case of pupils of the age of sixteen
     6  (16) years and over, the instruction [may] shall include
     7  practical instruction in the operation of motor vehicles on the
     8  public highways, or other places, selected by the board of
     9  school directors or by the principal of the school where the
    10  instruction is given.

    12     Section 2.  This act shall apply to the 2006-2007 school year
    13  and each school year thereafter.
    14     Section 3.  This act shall take effect immediately.
