                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for duplicate and substitute
     3     drivers' licenses and learners' permits in cases of identity
     4     theft.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1513 of Title 75 of the Pennsylvania
     8  Consolidated Statutes is amended by adding a subsection to read:
     9  § 1513.  Duplicate and substitute drivers' licenses and
    10             learners' permits.
    11     (a)  General rule.--If a learner's permit or driver's license
    12  issued under the provisions of this chapter is mutilated, lost,
    13  stolen, destroyed or becomes illegible, the person to whom it
    14  was issued, upon furnishing proof satisfactory to the department
    15  that the license or permit has been mutilated, lost, stolen,
    16  destroyed, or has become illegible, shall obtain a duplicate or
    17  substitute license or permit upon payment of the required fee.
    18     (a.1)  Identity theft victim provisions.--


     1         (1)  If a person reasonably demonstrated that the person
     2     is or may be the victim of identity theft, the department
     3     shall upon request issue in accordance with this subsection a
     4     substitute driver's license with a new operator's license
     5     number.
     6         (2)  Upon requesting a new driver's license number from
     7     the department, the person shall provide reasonable
     8     documentation indicating the person is or may be a victim of
     9     identity theft which may include, but not be limited to:
    10             (i)  A police report.
    11             (ii)  Notification that personal identity information
    12         was jeopardized by virtue of a computer breach or hack.
    13             (iii)  Documentation of the misuse of the person's
    14         existing driver's license number or a lost or stolen
    15         driver's license.
    16             (iv)  Other similar reporting method that indicates
    17         the possibility of identity theft or misuse of the
    18         person's driver's license number.
    19     (b)  Return of original.--If a duplicate or substitute
    20  learner's permit or driver's license has been issued, any person
    21  who finds or otherwise obtains possession of the original shall
    22  return the original to the department.
    23     Section 2.  This act shall take effect in 60 days.
