                                     AN ACT

     1  Amending the act of December 19, 1990 (P.L.1200, No.202),
     2     entitled "An act providing for the registration and
     3     regulation of solicitations by charitable organizations,
     4     professional fundraisers and other solicitors; imposing
     5     additional powers on the Department of State and the Office
     6     of Attorney General; prescribing civil and criminal
     7     penalties; and making a repeal," further providing for
     8     registration fees and late filing fees.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 5(p) and (q) of the act of December 19,
    12  1990 (P.L.1200, No.202), known as the Solicitation of Funds for
    13  Charitable Purposes Act, amended July 9, 1992 (P.L.436, No.92),
    14  are amended to read:
    15  Section 5.  Registration of charitable organizations; financial
    16                 reports; fees; failure to file.

    18     (p)  Annual registration fees.--[A charitable organization
    19  which submits a short form registration statement pursuant to
    20  section 7 or receives contributions of $25,000 or less during


     1  the immediately preceding fiscal year shall pay an annual
     2  registration fee of $15. A charitable organization which
     3  receives contributions in excess of $25,000 but less than
     4  $100,000 during the immediately preceding fiscal year shall pay
     5  an annual registration fee of $100. A charitable organization
     6  which receives contributions in excess of $100,000 but not
     7  exceeding $500,000 during the immediately preceding fiscal year
     8  shall pay an annual registration fee of $150. A charitable
     9  organization which receives contributions in excess of $500,000
    10  during the immediately preceding fiscal year shall pay an annual
    11  registration fee of $250. A parent organization filing on behalf
    12  of one or more affiliates and a federated fundraising
    13  organization filing on behalf of its member agencies shall pay a
    14  single annual registration fee for itself and such other
    15  affiliates or member agencies included in the registration
    16  statement.] No charitable organization required to register with
    17  the department pursuant to this section shall be required to pay
    18  a registration fee of any kind, unless such organization is
    19  subject to the criteria of subsection (q).
    20     (q)  Late filing fees.--[In addition to the registration fee,
    21  an] An organization failing to file a registration application
    22  by the due date shall pay [an additional] a fee of $25 for each
    23  month or part of the month after the date on which the
    24  registration statement and financial report were due to be filed
    25  or after the period of extension granted for such filing.

    27     Section 2.  This act shall apply to all registrations
    28  received on or after the effective date of this act.
    29     Section 3.  This act shall take effect immediately.
