AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, mandating ignition interlock systems.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Title 75 of the Pennsylvania Consolidated
6 Statutes is amended by adding a section to read:
7 § 4538. Ignition interlock systems.
8 (a) General rule.--Every motor vehicle manufactured for use
9 in this Commonwealth on and after December 31, 2008, and every
10 secondhand motor vehicle sold in this Commonwealth on and after
11 December 31, 2009, which is capable of having an ignition
12 interlock system installed, shall be equipped with a functional
13 ignition interlock system.
14 (b) Existing motor vehicle.--Every motor vehicle shall be
15 retrofitted to equip the vehicle with an ignition interlock
16 system by December 31, 2009.
17 (c) Definition.--As used in this section, the term "ignition
1 interlock system" has the meaning given that term in section
2 3801 (relating to definitions).
3 Section 2. This act shall take effect immediately.
