                                     AN ACT

     1  Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An
     2     act relating to insurance; amending, revising, and
     3     consolidating the law providing for the incorporation of
     4     insurance companies, and the regulation, supervision, and
     5     protection of home and foreign insurance companies, Lloyds
     6     associations, reciprocal and inter-insurance exchanges, and
     7     fire insurance rating bureaus, and the regulation and
     8     supervision of insurance carried by such companies,
     9     associations, and exchanges, including insurance carried by
    10     the State Workmen's Insurance Fund; providing penalties; and
    11     repealing existing laws," providing for coverage for
    12     dependent children.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  The act of May 17, 1921 (P.L.682, No.284), known
    16  as The Insurance Company Law of 1921, is amended by adding a
    17  section to read:
    18     Section 635.2.  Dependent Children.--(a)  If a health care
    19  insurance policy includes coverage for a dependent child who is
    20  a full-time student eighteen (18) years of age or older, the


     1  policy shall include coverage for the student's medically
     2  necessary leave or absence from school for a period not to
     3  exceed twelve (12) months or the date on which coverage would
     4  otherwise end pursuant to the terms and conditions of the
     5  policy, whichever comes first. To establish eligibility for
     6  coverage under this section, documentation and certification of
     7  the medical necessity of a leave of absence shall be submitted
     8  to the insurer by the student's attending physician.
     9     (b)  For purposes of this section, the term "health care
    10  insurance policy" means, subject to the provisions of subsection
    11  (c), any group health, sickness or accident policy or subscriber
    12  contract or certificate issued by an insurance entity subject to
    13  one of the following:
    14     (i)  This act.
    15     (ii)  The act of December 29, 1972 (P.L.1701, No.364), known
    16  as the "Health Maintenance Organization Act."
    17     (iii)  The act of May 18, 1976 (P.L.123, No.54), known as the
    18  "Individual Accident and Sickness Insurance Minimum Standards
    19  Act."
    20     (iv)  40 Pa.C.S. Ch. 61 (relating to hospital plan
    21  corporations) or 63 (relating to professional health services
    22  plan corporation).
    23     (c)  This section shall not apply to the following types of
    24  health care insurance policies:
    25     (1)  Accident only.
    26     (2)  Limited benefit.
    27     (3)  Credit.
    28     (4)  Dental.
    29     (5)  Vision.
    30     (6)  Specified disease.

     1     (7)  Medicare supplement.
     2     (8)  Civilian Health and Medical Program of the Uniformed
     3  Services (CHAMPUS) supplement.
     4     (9)  Long-term care or disability income.
     5     (10)  Workers' compensation.
     6     (11)  Automobile medical payment.
     7     Section 2.  This act shall take effect in 60 days.
