                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for the amounts of
     3     part-time student assistance grants.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3205 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3205.  Amount of grants.
     9     (a)  Full-time student assistance grants.--Grants awarded
    10  under this chapter to full-time students shall be determined by
    11  the agency without regard to financial need and shall not exceed
    12  for each academic year the lesser of:
    13         (1)  the tuition of the approved institution of higher
    14     learning for the approved program of education in which the


     1     member is enrolled; or
     2         (2)  the tuition charged to a resident of this
     3     Commonwealth at a member institution of the State System of
     4     Higher Education for the same academic year.
     5     (b)  Part-time student assistance grants.--Grants awarded
     6  under this chapter to part-time students who do not possess a
     7  baccalaureate degree shall be determined by the agency without
     8  regard to financial need and shall not exceed for each academic
     9  year or period the lesser of:
    10         (1)  [one-half of] the tuition for the part-time course
    11     of study in which the member is enrolled; or
    12         (2)  [one-third] two-thirds of the tuition charged to a
    13     resident of the Commonwealth at a member institution of the
    14     State System of Higher Education for the same academic year
    15     or period.
    16     (b.1)  Part-time student assistance grants for students
    17  possessing baccalaureate degrees.--Grants awarded under this
    18  chapter to part-time students who possess a baccalaureate degree
    19  shall be determined by the agency without regard to financial
    20  need and shall not exceed for each academic year or period the
    21  lesser of:
    22         (1)  one-half of the tuition for the part-time course of
    23     study in which the member is enrolled; or
    24         (2)  one-third of the tuition charged to a resident of
    25     this Commonwealth at a member institution of the State System
    26     of Higher Education for the same academic year or period.
    27     (c)  Other grants.--The agency shall not reduce the amount of
    28  other agency grants or aid for which the eligible member
    29  qualifies on account of the member's eligibility for or receipt
    30  of grants under this chapter.

     1     (d)  Adjustments.--If the agency and the Adjutant General
     2  determine that the amount appropriated for the program in any
     3  year will be insufficient to provide grants in the amounts set
     4  forth in this section to all eligible members, the agency and
     5  the department may reduce the maximum amount of the grants
     6  proportionately or set a limit on the number of participants to
     7  ensure that sums expended do not exceed appropriations.
     8     Section 2.  This act shall apply to grants awarded for any
     9  course of study commenced on or after May 1, 2006.
    10     Section 3.  This act shall take effect in 60 days.
