                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further providing for Federal programs.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2103 of the act of August 26, 1971
    11  (P.L.351, No.91), known as the State Lottery Law, added November
    12  26, 2003 (P.L.212, No.37), is amended to read:
    13  Section 2103.  Federal programs.
    14     (a)  General rule.--If the Federal Government enacts programs
    15  similar to PACE or PACENET, the State programs shall be
    16  construed to only supplement the Federal programs, and all
    17  persons qualified for coverage under the Federal program shall


     1  utilize that Federal program before utilizing any State program.
     2     (b)  Deposit of revenues.--Any revenues received by the
     3  Commonwealth as a direct result of the enactment of any Federal
     4  Government program similar to PACE or PACENET shall be deposited
     5  in the State Lottery Fund to be utilized to further supplement
     6  programs that benefit Pennsylvanians who are 65 years of age or
     7  older.
     8     Section 2.  This act shall take effect in 60 days.
