                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for protection of children from
     3     secondhand smoke.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 4587.  Secondhand smoke.
     9     (a)  Scope.--This section applies to all of the following:
    10         (1)  Passenger cars.
    11         (2)  Class I trucks.
    12         (3)  Class II trucks.
    13         (4)  Classic motor vehicles.
    14         (5)  Antique motor vehicles.
    15         (6)  Motor homes.
    16     (b)  Prohibition.--If a child under eight years of age is in
    17  a motor vehicle designated in subsection (a), an individual may
    18  not smoke or carry a lighted cigarette, cigar or pipe in that

     1  motor vehicle.
     2     (c)  Offense.--An individual who violates this section
     3  commits a summary offense and shall, upon conviction, be
     4  sentenced to pay a fine of $25. The court imposing the fine
     5  shall transfer the fine to the State Treasurer for deposit in
     6  the fund under section 4582 (relating to Child Passenger
     7  Restraint Fund).
     8     Section 2.  This act shall take effect in 60 days.
