                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing, in the State
     6     System of Higher Education, for powers and duties of the
     7     Board of Governors.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2006-A(a)(11) of the act of March 10,
    11  1949 (P.L.30, No.14), known as the Public School Code of 1949,
    12  added November 12, 1982 (P.L.660, No.188), is amended to read:
    13     Section 2006-A.  Powers and Duties of the Board of
    14  Governors.--(a)  The Board of Governors shall have overall
    15  responsibility for planning and coordinating the development and
    16  operation of the system. The powers and duties of the Board of
    17  Governors shall be:

    19     (11)  To fix the levels of tuition fees, except student
    20  activity fees. Tuition fees shall include a differential for

     1  such charges between students who are residents of the
     2  Commonwealth and students who are nonresidents. Tuition fees
     3  beginning with the school year 2006-2007 through the school year
     4  2008-2009 shall include a differential for such charges between
     5  students enrolled prior to the school year 2006-2007 and those
     6  initially enrolling beginning with the school year 2006-2007 and
     7  thereafter. No tuition increase shall apply to students enrolled
     8  prior to the school year 2006-2007 who continue their enrollment
     9  during the school year 2006-2007, 2007-2008 or 2008-2009.
