                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," permitting the Pennsylvania
    21     State Police to charge certain municipalities for certain
    22     services.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  Section 710(i) of the act of April 9, 1929
    26  (P.L.177, No.175), known as The Administrative Code of 1929,
    27  added October 3, 1986 (P.L.1414, No.129), is amended and the

     1  section is amended by adding a subsection to read:
     2     Section 710.  Pennsylvania State Police.--The Pennsylvania
     3  State Police shall have the power and its duty shall be:
     4     * * *
     5     (i)  To collect information relating to crimes and incidents
     6  related to the race, color, religion or national origin of
     7  individuals or groups, which shall be reported monthly by all
     8  local law enforcement agencies and the State Fire Marshal. Any
     9  information, records and statistics collected in accordance with
    10  this subsection shall be available for use by any agency
    11  required to furnish information, to the extent that such
    12  information is reasonably necessary or useful to such agency in
    13  carrying out the duties imposed on it by law. The Commissioner
    14  of the Pennsylvania State Police may, by regulation, establish
    15  such conditions for the use or availability of such information
    16  as may be necessary to its preservation, the protection of
    17  confidential information, or the circumstances of a pending
    18  prosecution[.];
    19     (j)  To establish a fee schedule for services rendered to
    20  municipalities having a population in excess of ten thousand
    21  (10,000) or a population density in excess of one hundred sixty
    22  (160) persons per square mile which rely on the Pennsylvania
    23  State Police as the primary police agency. Fees shall not be
    24  established for specialized police services available to all
    25  municipalities, only for primary police services in
    26  municipalities without the protection of an organized police
    27  department. Such fees shall be paid into the General Fund.
    28     Section 2.  This act shall take effect in 60 days.
