                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for penalties for violations
     3     involving persons with disability plates or placards.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1338(d) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1338.  Person with disability plate and placard.
     9     * * *
    10     (d)  Penalty.--[Any person violating this section commits a
    11  summary offense and shall, upon conviction, be sentenced to pay
    12  a fine of not more than $100.]
    13         (1)  Any person, including a physician, who alters or
    14     falsifies a health care provider's statement for a special
    15     plate or parking placard for persons with disabilities
    16     commits a misdemeanor of the third degree and, upon
    17     conviction, for a first offense shall be sentenced to pay a
    18     fine of $1,000 or to undergo a term of imprisonment not to

     1     exceed 90 days, or both. For a second or subsequent offense
     2     of alteration or falsification of a health care provider's
     3     statement, the person, including a physician, upon
     4     conviction, shall be sentenced to pay a fine of not more than
     5     $2,000 or to a term of imprisonment not to exceed 120 days,
     6     or both.
     7         (2)  Any person who violates any provision of this
     8     section other than a violation referred to in paragraph (1)
     9     commits a summary offense and shall, upon conviction, be
    10     sentenced to pay a fine of not more than $500.

    12     Section 2.  This act shall take effect in 60 days.
