           PALLONE, PHILLIPS, REICHLEY, SCAVELLO, STERN, THOMAS AND
           YOUNGBLOOD, MARCH 1, 2005

                                     AN ACT

     1  Amending the act of July 9, 1987 (P.L.220, No.39), entitled "An
     2     act licensing and regulating the practice of social work;
     3     providing penalties; and making an appropriation," further
     4     providing for reciprocity.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 10 of the act of July 9, 1987 (P.L.220,
     8  No.39), known as the Social Workers, Marriage and Family
     9  Therapists and Professional Counselors Act, amended December 21,
    10  1998 (P.L.1017, No.136), is amended to read:
    11  Section 10.  Reciprocity or endorsement.
    12     [The board shall have the power to grant a reciprocal license
    13  to an applicant who is licensed or certified as a social worker,
    14  clinical social worker, marriage and family therapist or
    15  professional counselor in another state and has demonstrated
    16  qualifications which equal or exceed those required pursuant to
    17  this act in the determination of the board, provided that no
    18  license shall be granted under this section to an applicant

     1  unless the state in which the applicant is licensed affords
     2  reciprocal treatment to persons who are residents of this
     3  Commonwealth and who are licensed pursuant to this act.]
     4  Reciprocity or endorsement may be established at the discretion
     5  of the board. As used in this section, the term "reciprocity"
     6  means the act of the board and a licensing authority in another
     7  jurisdiction, each recognizing that the requirements for a
     8  license or certificate in this Commonwealth and in the other
     9  jurisdiction are equivalent, issuing a license or certificate to
    10  an applicant who possesses a similar license or certificate in
    11  the other jurisdiction. As used in this section, the term
    12  "endorsement" means the issuance of a license or certificate by
    13  the board to an applicant who does not meet standard
    14  requirements, if the applicant has achieved cumulative
    15  qualifications which are accepted by the board as being
    16  equivalent to the standard requirements for the license or
    17  certificate.
    18     Section 2.  This act shall take effect in 60 days.
