AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for simple assault.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 2701(b) of Title 18 of the Pennsylvania
6 Consolidated Statutes is amended to read:
7 § 2701. Simple assault.

9 (b) Grading.--Simple assault is a misdemeanor of the second
10 degree unless committed:
11 (1) in a fight or scuffle entered into by mutual
12 consent, in which case it is a misdemeanor of the third
13 degree; [or]
14 (2) against a child under 12 years of age by an adult 21
15 years of age or older, in which case it is a misdemeanor of
16 the first degree[.]; or
1 (3) while committing a retail theft as defined in
2 section 3929 (relating to retail theft), in which case it is
3 a misdemeanor of the first degree.
4 Section 2. This act shall take effect in 60 days.
