                                     AN ACT

     1  Establishing the Flood Protection and Mitigation Tax Fund; and
     2     conferring powers and duties on the Pennsylvania Emergency
     3     Management Agency and the Pennsylvania Liquor Control Board.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Flood
     8  Protection and Mitigation Tax Act.
     9  Section 2.  Definitions.
    10     "Agency."  The Pennsylvania Emergency Management Agency.
    11     "Board."  The Pennsylvania Liquor Control Board.
    12     "Fund."  The Flood Protection and Mitigation Tax Fund
    13  established in section 4.
    14  Section 3.  Administration.
    15     (a)  Pennsylvania Emergency Management Agency.--The agency
    16  has the power and duty to utilize money in the fund to assist

     1  with expenses caused by the Flood of 2004.
     2     (b)  Pennsylvania Liquor Control Board.--The board has the
     3  power and duty to make the transfer under section 4(b).
     4  Section 4.  Fund.
     5     (a)  Establishment.--The Flood Protection and Mitigation Tax
     6  Fund is established as a restricted fund in the State Treasury.
     7     (b)  Source.--The source of the fund is the annual transfer
     8  of $55,000,000 into the fund from the tax collected under the
     9  act of June 9, 1936 (1st Sp.Sess., P.L.13, No.4), entitled "An
    10  act imposing an emergency State tax on liquor, as herein
    11  defined, sold by the Pennsylvania Liquor Control Board;
    12  providing for the collection and payment of such tax; and
    13  imposing duties upon the Department of Revenue and the
    14  Pennsylvania Liquor Control Board."
    15     (c)  Use.--The agency shall use the money in the fund as set
    16  forth in section 3(a).
    17     (d)  Continuing appropriation.--The money in the fund is
    18  continuously appropriated into the fund. This appropriation
    19  shall not lapse at the end of any fiscal year.
    20  Section 20.  Effective date.
    21     This act shall take effect immediately.
